I also had the opportunity to work pro bono for the United Nations during 1997-2001. Kofi Annan asked Jim Baker to become his personal envoy to help resolve the long-standing dispute over the future of the Western Sahara, a former Spanish colony on the west coast of Africa where a guerilla war had been festering for over twenty years. Baker’s mission was to bring about a referendum the UN Security Council had resolved to hold in 1991 to determine whether the Western Sahara would be annexed by Morocco, which had held de facto control of the territory since 1975, or achieve independence. Despite baker’s leadership and our strenuous efforts to get the disputing parties to agree on the voting rules for the referendum, we did not succeed and the Western Sahara matter was still pending when I arrived in New York in August 2005.

Fortunately, the 2000 Florida recount, although at times it seemed liked guerilla warfare, did not last as long as the dispute over the Western Sahara. By mid-December 2000, although somewhat delayed by the length of the election dispute, the Bush Transition Team turned its full attention to the new administration’s staffing and policies. And so did I.

Annan had just had shoulder surgery, his arm was in a sling, and he seemed very unanimated, perhaps due to his medication. I opened my mentioning that the last time I had been in the informal consultations room was when I’d accompanied Jim Baker, reporting on the 1997 Houston Accords on the Western Sahara. One of my goals, I suggested, might be finally to bring the long-running peacekeeping operation to a close by actually holding the referendum on the future status of Western Sahara that it had been established to undertake. There was laughter around the room, which turned out to be justified, since the fifteen-year-old effort was still struggling along unchanged when I left sixteen months later.

Western Sahara

Because of my work in Bush 41 and then with Jim Baker on the Western Sahara, I had a particular interest in trying to wrap up this fifteen-year-old peacekeeping operation, and in giving the residents of the territory the referendum on its future status they had long been promised. Morocco initially agreed to a referendum – that was, after all, what the “R” in MINURSO, the Spanish acronym for “Mission of the United Nations for the Referendum in Western Sahara,” stood for –but consistently blocked taking the steps necessary to conduct it, such as voter identification and registration. This was a clear example of the limitations of UN peacekeeping, which Sudan’s government was demonstrating contemporaneously in Darfur, namely that there simply was no chance of success if any of the actual parties to a dispute dug in their heels and refused to cooperate. In that sense, at least with respect to UN operations directly affecting them, almost every UN member has a kind of veto, not just the Security Council’s Perm Five. This is undoubtedly why the UN so often resembles the League of Nations in its achievements.








I met repeatedly in 2005-6 with the perm reps of Algeria and Morocco, both of whose countries were quite satisfied with the status quo in the territory, but for essentially opposite reasons. Morocco is in possession of almost all of the Western Sahara, happy to keep it that way, and expecting that de facto control will morph into de jure control over time, giving it both territorial breadth consistent with its historical concept of the “proper” size of Morocco and access to possible natural resources and fishing rights.
Morocco’s alternative to a referendum was “autonomy” for the territory, which meant effectively keeping it under Moroccan control. Algeria, the main supporter for the POLISARIO (the political and military vehicle for the Sahrawi rebellion), tens of thousands of whose refugees lived in camps near Tindouf in southwestern Algeria, liked having the threat of POLISARIO action against Morocco, but found the threat more useful than the actual prospect of renewed hostilities. In fact, unresolved tensions between Morocco and Algeria, unrelated to the Western Sahara, were a major factor in the dispute, not that anyone talked about them very much.
Peter van Walsum, a retired senior Dutch diplomat with extensive UN experience as a former perm rep, and Baker’s replacement as the SG’s personal envoy for the Western Sahara, tried repeatedly in 2005 to see if any Council member, especially the United States, planned to pressure Morocco to adhere to its many commitments to hold a referendum. He found that none were willing, except Algeria, which of course Morocco would ignore.

One of the high points of my tenure at the UN came when van Walsum briefed the Security Council on April 25, 2006, explaining that “international legality” (the World Court having rejected Morocco’s claim of sovereignty over the Western Sahara) was in conflict with “political reality” (Morocco’s control over almost all of the territory), and that the Council had to find a compromise. Although many countries could not conceive of a conflict, let alone a “compromise” where “international legality” might give way to mere “political reality,” I was delighted that someone had at least spoken the unspeakable, even though his logic cut against the Sahrawi position.
If only others were as forthright as van Walsum.




Since it was clear that Morocco had no intention of ever allowing a referendum, there was no point in a UN mission to conduct one. Instead, and typically of the UN, MINURSO seemed well on the way to acquiring a near-perpetual existence because no one could figure out what to do with it.
Accordingly, consistent with my fundamental notion that the Security Council should try to find a real solution to the underlying problem, I suggested terminating MINURSO and releasing the Sahrawis from the cease-fire they had agreed to in exchange for the promise of a referendum.
If Morocco didn’t like that prospect, then let it get serious about allowing a referendum. If not, then the Council should admit its failure and get out, or at least not become another part of the problem by locking in a status quo
that could go on indefinitely. Otherwise, MINURSO seemed a perfect example of costly UN peacekeeping operations that were not promoting resolutions to conflicts, but prolonging or even complicating them.


The biggest obstacle to my approach was, as usual, the State bureaucracy, joined unusually by the NSC’s Elliot Abrams. They accepted Morocco’s line that independence for the Western Sahara – which nearly everyone thought the Sahrawis would choose in a genuinely free and fair referendum- would destabilize Morocco and risk a takeover by extreme Islamicists. This was why the administration had rejected the last “Baker Plan” in 2004, and why Baker finally resigned as the SG’s personal envoy after eight years of trying to resolve the issue. I wondered what had happened to the Bush administration’s support for “democracy” in the broader Middle East, but there was no doubt here that stability for King Mohammed VI trumped self-determination. In practice, it meant that State was always open to plans for “autonomy” for Western Sahara, which Morocco, at regular intervals, promised to produce, and invariably never did, at least not until after long delays. I engaged in a number of frustrating and unsuccessful efforts to find support for the referendum elsewhere in the U.S. government, but failing to do so, Abrams and I agreed to convene a meeting at State on June 19, 2006, to see if he and I could come up with a common strategy. If so, we knew that the bureaucracy, having no alternative ideas, would endorse it.


I explained my view to the meeting, which had over thirty attendees, which was that MINURSO had failed in its central mission to conduct a referendum and was now actually an obstacle to Morocco and Algeria dealing with each other and the continuing fact of tens of thousands of Sahrawi refugees; that in the absence of someone with Jim Baker’s status, the UN had essentially no political role to play; and that Morocco was never going to agree to a referendum where independence was a real option. Abrams stressed stability in Morocco, but said if Morocco came out with a “true” autonomy plan, he could support terminating MINURSO. I still thought the reverse was true, namely that neither Morocco nor Algeria would get serious until they saw MINURSO about to disappear, and I never believed that Morocco would tolerate “true” autonomy. Nonetheless, during this one-hour meeting, we had stretched the limits of bureaucracy about as far as we could, and I made at least some progress on the idea that eliminating MINURSO would not impede the search for a solution, but might actually be the only way to achieve one. Other than Abrams and me, all of the representatives from the rest of the bureaucracy wanted to defend the status quo. At this rate, of course, MINURSO would have perpetual life, and this was the United States that couldn’t figure out what it wanted to do, let alone the UN !

In fact, in March 2007 Morocco promulgated yet another “autonomy” plan, with no provision for a referendum, and the Sahrawis rejected it yet again. This could well go on forever. The Security Council has gone back to sleep.

كشف السفير الأمريكي السابق أمام الأمم المتحدة، جون بولتون، أن إدارة البيت الأبيض تتجنب فرض إجراء تقرير المصير في الصحراء الغربية حفاها علي التوازن السياسي في المغرب، وذلك لمعرفتها المسبقة أن الاستفتاء سيكون في صالح الصحراويين وفرصة للإسلاميين للوصول الي الحكم في المغرب.
كشف بولتون عن هذه المعلومات في كتاب صدر هذه الأيام تحت عنوان الاستسلام ليس خيارا يعالج فيه عددا من القضايا التي تهم السياسة الخارجية الأمريكية ومشاركته في صنع بعض القرارات بحكم المناصب التي شغلها في الدبلوماسية الأمريكية خاصة منصب السفير في مجلس الأمن قبل تقديم استقالته.
ويعتبر جون بولتون من المطلعين جيدا علي هذا الملف لأنه كان ما بين 1997 و2000 المساعد الرئيسي لوزير الخارجية الأسبق جيمس بيكر عندما شغل منصب المبعوث الخاص للأمين العام للأمم المتحدة في نزاع الصحراء الغربية.
وكان بيكر قد قدم استقالته سنة 2004 عندما أدرك أن النزاع لن يشهد طريقه الي الحل بسبب رفض المغرب اجراء الاستفتاء.
ويقدم بولتون نبذة تاريخية عن صراع الصحراء الغربية منذ نشأته حتي الآن، والمراحل التي مر بها خلال الثلاثين سنة الأخيرة منذ النطق بالحكم في المحكمة الدولية لهاي سنة 1975 الذي اعترف للمغرب بروابط روحية مع سكان الصحراء ولكن دون روابط السيادة المادية، وأغفل بولتون جزءا هاما في الملف هو النزاع الذي كان قائما بين المغرب واسبانيا حول الصحراء الغربية ما بين 1956 الي 1975، أي عشرين سنة الأولي قبل ظهور جبهة البوليزاريو التي تنازع المغرب السيادة علي هذه الأراضي.
ويكشف بولتون أنه تقدم بمقترح ينص علي سحب قوات الأمم المتحدة لحفظ السلام من الصحراء الغربية مينورسو وبالتالي عودة المواجهات المسلحة ووقتها سيحدث بدون شك الاستفتاء.
ويري أن الادارة الأمريكية كان لها موقف مختلف للغاية يتجلي في دعم الموقف المغربي. ويقول في هذا الصدد ان أكبر عرقلة من وجهة نظري هي بيروقراطية وزارة الخارجية التي يدعمها مجلس الأمن القومي ممثلا في ابراهمس إليوت، فالإثنين قبلا فكرة ان استقلال الصحراء الغربية الخيار الذي سيصوت عليه غالبية الصحراويين بكل تأكيد سيخل باستقرار المغرب لصالح الاسلاميين المتطرفين الذين قد يحصلون علي الحكم، وهو ما جعل الادارة الامريكية ترفض خطة بيكر لعام 2004 وبالتالي دفعه الي الاستقلال .
ويقول في كتابه عن بعض المحاولات الأخيرة التي بذلها للوصول الي حل الذي يبقي في نظره هو اجراء الاستفتاء في هذا الملف لقد قمت بالعديد من المحاولات أملا في العثور داخل أو وسط الادارة الأمريكية عمن يؤيد تنظيم استفتاء تقرير المصير ولكن دون جدوي . ويضيف كنت شخصيا، وأبراهمس إليوت، قد اتفقنا علي الاجتماع في وزارة الخارجية يوم 19 كانون الثاني/يناير 2006 للبحث عن استراتيجية مشتركة وقد شرحت خلال هذا اللقاء الذي ضم حوالي 30 مشاركا أن الأمم المتحدة لم يعد لها دور سياسي تلعبه في غياب شخصية من حجم جيمس بيكر وان المغرب لا تتوفر لديه إرادة قبول تنظيم استفتاء في الصحراء الغربية يتضمن خيار الاستقلال ضمن الخيارات الممكنة إلا ان ابراهمس كان دائم التمسك بضرورة أخذ استقرار المغرب بعين الاعتبار .
يذكر أن جبهة البوليزاريو تتمسك بإجراء استفتاء تقرير المصير في حين يصر المغرب علي الحكم الذاتي للصحراويين تحت السيادة المغربية كحل مناسب لهذا النزاع والمحافظة علي التوازن في منطقة المغرب العربي.
وكان آخر موقف للدبلوماسية الأمريكية من النزاع هو الذي أعرب عنه مساعد وزيرة الخارجية الأمريكية دفيد والش خلال يونيو الماضي عندما صرح مقترح المغرب بمنح الصحراويين الحكم الذاتي نعتقد أنه فرصة لتحقيق اتفاق لهذا النزاع .

Members of the World Affairs Council, Distinguished Guests, Ladies and Gentlemen,

I am grateful to have been invited here to speak about Western Sahara. To prepare for my visit here, I saw the movie Into The Wild. I was expecting my accommodations here to be a used school bus. I was pleasantly surprised by a delightful hotel room. I do remain quite wary of any herbs in my salad.

By definition, your Council has a healthy curiosity about what is happening all over the world. My predecessors at this podium have been the presidents of Mongolia and Iceland. I am so glad your attention is now focused on North Africa, Morocco and how the United Nations performed and is performing in resolving Morocco’s invasion and retention of what is the world’s last colony: Western Sahara. I am going to speak briefly about the history of the conflict over Western Sahara, my role in the initial and failed referendum and then the prospects here and now, in 2007, for resolving the conflict. I intend to leave plenty of time for your questions. The audience’s questions are always the most interesting part of any presentation.

THE PLACE:

Western Sahara is country about the size of Colorado, just below Morocco, located just where the name says it should be, on the western edge of the Sahara. I am going to start in the middle of things as they say good stories should, with the 1995 congressional hearing into how the U.N. spends the money we Americans appropriate for it. That led to the U.N.’s handling of the referendum scheduled for Western Sahara. Finally, I will move to 2007 and what’s happening now to resolve the issue.

In January 1995 I was a witness in that congressional hearing looking into U.N. spending of U.S. taxpayer money. Chuck Lichenstein, a former U.S. ambassador to the U.N. and deputy to Ambassador Jeane Kirkpatrick. Despite, or perhaps because of his proximity to the institution, he was not a great fan of the U.N. You may recall his well-publicized remarks in 1983. Chuck said: “If, in the judicious determination of the members of the United Nations they feel they are not welcome and treated with the hostly consideration that is their due, the United States strongly encourages member states to seriously consider removing themselves and this organization from the soil of the United States. We will put no impediment in your way, and we will be at the dockside bidding you a farewell as you set off into the sunset.”
It was Chuck who viewed the U.N.’s actions in Western Sahara as so outrageous, even by U.N. standards, that he gave up his place so that I could address the congressional committee that day.

A LITTLE BACKGROUND:

Western Sahara used to be a Spanish colony called Spanish Sahara. Under U.N. pressure to decolonize, Spain agreed to withdraw from Spanish Sahara but not before it organized a referendum to allow the inhabitants to vote on their own, decolonized, future. But even before Spain withdrew, Morocco had appeared before the World Court in The Hague and claimed sovereignty over Spanish Sahara. The World Court rejected Morocco’s position and in its opinion made two very important points: First, that Morocco had no claim to sovereignty over Spanish, now Western, Sahara, and secondly, that the referendum organized by Spain should go forward. The day after that decision was announced, Morocco invaded Western Sahara in what was called “the Green March.” Morocco has occupied Western Sahara ever since, leading to what has become the longest, most protracted conflict in the history of the United Nations.

To put this in context, U.S. Congressman from Illinois, Jose Serrano recently proposed legislation, to let the people of Puerto Rico decide by referendum whether to remain part of the United States or become an independent state. I am taking the license of grossly over-simplifying the Serrano proposal to make a point, but imagine if the Serrano proposal were enacted into law, and the Supreme Court said such a referendum must be held, but the U.S. Government ignored that decision and sent in troops to take control of the island as U.S. property and postpone the referendum indefinitely. Admittedly, this is a Twilight Zone scenario, but it does give a pretty god idea of what has been going on between Morocco and Western Sahara.
The indigenous people of Western Sahara, nomads known as Sahrawis, through their military arm, the POLISARIO Front, forcefully resisted the Moroccan colonizers just as they had resisted the Spanish colonizers before them. Morocco eventually over-powered the POLISARIO but not before the POLISARIO, although vastly out-gunned and out-manned, gave the Moroccans a bloody nose. The Sahrawis did not give in but created a government-in-exile in Algeria.
In 1991, the U.N. Settlement Plan for Western Sahara provided for a cease-fire as well as for a U.N. supervised referendum on self-determination that would let the Sahrawis decide whether to be integrated into Morocco or become an independent state. If ever there were a job ready-made for the U.N., this surely was it. The referendum was scheduled for 1992 but was postponed until 1994. That’s where I came in.

THE REFERENDUM:

The U.N. hired me to run the referendum in Western Sahara. It was the principal activity of a U.N. peacekeeping mission called MINURSO. All U.N. missions have names that sound like cough syrups. I thought the U.N. was serious. Maybe some in the U.N. were at the time, but the referendum was, and continues to be, one of those colossal and tremendously expensive flops that make a laughing stock of the U.N.

The U.N.’s task was simple enough: Hold a referendum with one issue to be decided: independence or integration with Morocco. Or so the story was. In the event, however, it wasn’t quite so simple. The U.N. turned over control of the referendum to Morocco. There really is no other way of describing what happened. Morocco dictated the where and when of the voting registration, controlled entry to the U.N. voter registration facilities, and even decided which Sahrawis got to register.

The Moroccan observers at the voter registration sessions had observed right off the bat that the people of Western Sahara wanted independence, not integration with Morocco. The way for Morocco to deal with that unpleasant reality was to postpone the referendum indefinitely until it appeared unworkable, leaving Morocco just where it was, controlling Western Sahara. And that’s just what Morocco did.

Towards the end of my year in Western Sahara, I was instructed to make my reports jointly to the U.N. Secretary General’s representative and the Moroccan representative. There was no longer even the pretense of an independent U.N. mission in Western Sahara.

What I described to the Congress about the U.N.’s scandalous performance in Western Sahara was not some personal insight. Morocco’s abuse of the people of Western Sahara, and the U.N. mission’s impotence to stop that abuse, was open and notorious. The U.N. mission was a laughing stock at diplomatic parties in Rabat. The mission’s abandonment of a free and fair referendum was common knowledge to all the peacekeeping soldiers assigned to the mission as well as to the U.N. staff. That is the reason Chris Hedges of The New York Times had no trouble getting the facts he needed to expose in print the referendum for the sham it was.

One had to be cynical in the face of the U.N.’s high falutin’ language and do-nothing results, but when it was announced in 1997 that former Secretary of State Baker was undertaking to get this referendum back on track, many people, myself included, were impressed. More than impressed. I was hopeful for the first time in a very long time. I attended the Capitol Hill conference he held, and I eagerly read the reports of his meetings in Morocco, Algeria, Lisbon and London. He would resolve the impasse or, as he said, he would at least identify who was holding up the referendum. He was the great hope for a peaceful settlement.

Sadly, Secretary Baker not only failed to get the referendum back on track, he failed to identify who was holding up the referendum, not that there was any doubt about it. He proposed a five-year period of so-called autonomous rule by the Western Saharans, under the benevolent eye of the Moroccans, of course, to be followed by a referendum. It seemed an absurd proposal. If after so many years and so many millions spent, the U.N. was unable to hold a simple referendum, what kind of quixotic reasoning could justify putting one’s faith in some other referendum five years hence, during which time the Moroccans would continue to send thousands of Moroccans into Western Sahara as homesteaders ? The Baker proposal was so clearly in Morocco’s favor that no one expected the Sahrawis to accept it. But amazingly they did, in a gesture of conciliation. The Moroccans, for whom the proposal was a leontine pact, rejected it. Go figure.

Horace, the Roman poet, wrote “The mountains are in labor, and a mouse is brought forth.” We expected a great diplomatic Mt McKinley from Secretary Baker’s intervention but, sadly, he had presented us with a diplomatic mouse.
It is appropriate that we talk about these things now because the world has just recognized, we can hardly say celebrate, the 32nd anniversary of Morocco’s invasion of Western Sahara. We can’t say celebrate unless we also celebrate Indonesia’s, murderous grab of East Timor which Morocco’s invasion most resembles.
One other point worth noting is the great waste of money in the referendum, estimated at $100,000 a day as far back as 1995. That was then a scandalous amount. These days, after the Volcker Report on the U.N. Oil for Food Scandal, it is chicken feed. But there are some similarities.

U.N. Secretary General Kofi Annan, whose son prospered through the Oil for Food Scandal, was head of U.N. peacekeeping, and therefore of Minurso when the referendum began. He exhibited there the same dereliction of management duty in MINURSO as would later be documented in the Volcker Report.

What I had observed in MINURSO and testified to before our Congress was later verified by Human Rights Watch, Amnesty International, various newspapers and journals, including The New York Times, The Economist, and on and on.

U.N. BAD FAITH:

Worse than the extravagant waste of money on this mission over the years was the U.N.’s duplicity in managing it: the U.N. sold out the nobodies, the Sahrawis for whose right to self-determination the referendum was to be held, to keep favor with a somebody, King Hassan II of Morocco, who had invaded Western Sahara, lost his claim to the territory in the World Court, but succeeded in convincing his old chum and fellow North African, Boutros Boutros-Ghali, to provide a U.N. fig leaf to cover Morocco’s naked aggression and occupation of Western Sahara. And this is an important point. To hear the Moroccans tell it themselves or through their multi-million dollar Washington lobbyists, the World Court ruled in Morocco’s favor back in 1975. As noted earlier, the Court did no such thing, and I invite all of you to google the decision and read it for yourselves.

WHAT WENT WRONG IN THE REFERENDUM:

Those same well-paid lobbyists I just mentioned emphasize what a great ally of the United States Morocco is. Well, that happens to be the truth. Morocco is not evil incarnate. The point is, however, that however helpful Morocco is to us in carrying out diplomatic missions elsewhere, particularly in the Middle East, that same ally, Morocco, acted more like the Mafia in Western Sahara. For example:
Arabic speakers working for the U.N. came to me to report that Sahrawis coming in to register as voters were complaining to them (in Hassania, the local Arabic dialect) that members of their families and friends had registered to vote at the Moroccan-run centers but never appeared on the voters list. The Moroccans had disenfranchised them. Others complained that relatives and friends were on the list to register as voters, but the Moroccans refused to let them do so. The Moroccan police kept away everyone who wasn’t approved by the Moroccan authorities. People coming to register on a given day couldn’t just walk in. Only those with the Moroccan seal of approval could enter. In this way, the Moroccans controlled who registered to vote. Welcome to the Moroccan-run police state of Western Sahara. That’s just not the way it’s supposed to be, of course, and that’s not the kind of the process the U.N. is supposed to be funding.

For this same reason we could not invite Sahrawis to fill out voter application at our centers. No Sahrawi was allowed anywhere the Moroccan Government doesn’t want him or her to be. It cannot be stressed too strongly, Western Sahara, under Moroccan control, is a police state, something we as Americans are not used to, a fully functioning and efficient police state.

One other observation: Some Sahrawis who reported what the Moroccans were doing to them asked that our U.N. people keep an eye out for them in case they disappeared. Many said they were scared for their lives if the Moroccans saw them talking to U.N. people. Others asked not to be recognized outside the U.N. center. Terrorized is not too strong a word. Their comments reminded me of nothing so much as South Africa in the early 70’s when blacks would talk to you freely in the safety of the U.S. embassy in Cape Town or Pretoria, and then pretend they didn’t know you as soon as they left, lest they be observed by the South African Special Branch talking to “ foreign trouble-makers.”

Morocco didn’t and still doesn’t want the referendum because the risks outweigh any possible gains. From Morocco’s point of view, the status quo is not so bad. But for P.R. reasons, Morocco cannot afford to appear to be the villain of the piece and continues to find ways to delay any referendum until everyone is sick of it. This is a long-standing practice that sometimes is simply absurd. On one occasion, like something out of Ionesco, Morocco halted the identification process for over a week, at a cost, once again, of $100,000 per day, on the question of the whether an adverb used in a schedule proposed by MINURSO was le mot juste. This resulted in an exchange of formal letters and a good deal of sophomoric quibbling. If Morocco had been interested in clarifying the matter, as opposed to simply delaying the process, it could have been done so in two minutes in a phone call to the French-speaking former Togolese ambassador, who drafted the letter.
In the same month, the Moroccan liaison officer with MINURSO, one Mohammed Azmi, bragged publicly to a group of MINURSO people in a bar that he alone was the one to decide whether identification would go forward the next day, and to prove his point, he picked up the phone (it was then about midnight) and, in front of everyone, cancelled the next week’s identification sessions.

These are the actions of Machiavellians who do what they please with impunity from U.N. sanctions and without a care for the integrity of the referendum or the waste they are incurring.
The identification process was supposed to begin on June 15, 1994, but the start was delayed two-and-a-half months, at a cost of millions of dollars, while the U.N., the Sahrawis and Morocco engaged in more time-wasting, this time negotiating over what to call the Organization of African Unity (O.A.U.) representatives who were to come to observe the identification. The Moroccans had walked out of the O.A.U. years before because it recognized the Sahrawi Arabic Democratic Republic (R.A.S.D.), the diplomatic name for the Sahrawi homeland, and now Morocco said they didn’t want O.A.U. people involved in the referendum. The O.A.U. representatives were part of the referendum process and, as the Moroccan knew, had to be there. In the end a compromise about what they were to be called was reached, and the O.A.U. representatives were permitted to enter. The absurdity was that this had all been worked out in 1993 so there was no need, except delay for the sake of delay, to reinvent the wheel once the referendum was beginning.

THUGGERY:

Each person who registered to vote got a receipt, and when the list of those eligible to vote was made public, the persons on that list were supposed to turn those receipts in for a voter’s card. What was happening in Laayoune, the capital of Western Sahara, is that Sahrawis returning from the voter registration centers were being forced to turn in their receipts to the Moroccans. This allowed the wrong people to present receipts and get voter cards. In Chicago they call that voter fraud.

The voter registration process began in earnest on August 28, 1994, simultaneously in Western Sahara and in Algeria, the location of the Saharawis’ government-in-exile. One can say that surely, as of this date, MINURSO ceased to be a U.N.-run operation and became the instrument for Morocco’s domination of the voter identification process.
You need government permission to buy space on Moroccan media, and Morocco had always denied the U.N. permission to buy space in the Moroccan newspapers or radio to alert people to register to vote. (Freedom of the press is also a casualty in a police state.) That was small potatoes compared to what was to come after August 28. Former British Prime Minister Harold Macmillan referred to the technique the Borgia brothers would use to take over a Northern Italian town. Watching the Moroccans at work, I thought of his description.

SOME FOR INSTANCES:

The evening before the voter registration process began in Laayoune, the Moroccan Liaison with MINURSO upbraided the MINURSO Chief-of-Mission, a Mr. Eric Jensen, in a public dining room before Moroccans and MINURSO staff, and directed him to remove all U.N. flags from the U.N. building where the voter registration was to take place, or he would close down the voter registration. Unfortunately, John Wayne the Chief-of-Mission was not, and he even ordered that the U.N. flag in the room where the opening ceremony was to take place be removed.

During the days of the opening sessions in Laayoune, so-called Moroccan journalists photographed and videotaped every minute of every day and took the picture of each Sahrawi who came to be identified. These so-called journalists were, as our press people and the German head of U.N. police observers verified, Moroccan security agents. Not one second of these hours of so-called television footage ever appeared on Moroccan television.

A few weeks later, telephone taps were found on local and all international lines at MINURSO headquarters. The taps went to a local Moroccan line. This was hushed up. There was no investigation, but the U.N. employee who installed the taps was secreted away to avoid any evidence implicating the U.N.
Mail had regularly been tampered with, and rooms of MINURSO personnel were regularly searched, but this was a new wrinkle. Big Brother was now listening to, as well as watching, us.
In the following weeks, Morocco, not the U.N., dictated even our work and flight schedules. When the Moroccan observers agreed, the U.N. worked. The Moroccans also insisted that U.N. planes fly empty, and at great expense, from Laayoune where the planes are based, across the desert to the Saharawi camps in Algeria to shuttle Moroccan observers back home and, of course, to demonstrate their control of the process.

In Laayoune, the Moroccans treated the U.N. voter identification facilities as their own, running in groups of visiting firemen whenever they liked and keeping the facilities open, if that’s what it took, to accommodate late arrivals. On one occasion, when the Moroccan liaison with MINURSO arrived at the identification center, he was furious to find he had to wait a few moments for the gate to be unlocked so he could enter what he called “chez moi,” my place. And that is how the Moroccans were permitted, through U.N. timidity, to think of the U.N. facilities in Laayoune, not as an extra-territorial U.N. compound, but as their own property.

In summary, during my time in Western Sahara, Morocco conducted, without a raised eyebrow from Boutros-Ghali’s handpicked representative, a campaign of terror against the Saharan people. As noted earlier, I had not seen the likes of it since I observed the apartheid government in South Africa in action against South African blacks when I visited there with Roy Wilkins, then head of the N.A.A.C.P., in the early 70’s. Morocco did not simply influence the referendum -- they controlled it – down to what days the mission worked. Morocco tapped U.N. phones, intercepted U.N. mail, and searched the living quarters of U.N. staff with impunity. More importantly, the Moroccan authorities disenfranchised Saharan voters right and left and substituted Moroccan ringers in their place.

Outsiders like me, as well as U.N. contract employees and veteran U.N. professionals, reported these outrages directly to Boutros-Ghali’s representative in MINURSO, but we might just as well not have bothered. Boutros Ghali’s man blew them off. He simply lacked the gravitas, or the moxie, to take on the King’s gangster-in-chief in Western Sahara, Mohammed Azmi. If you read Graham Greene’s Our Man in Havana, you would recognize him: a charming and ruthless flic, like Greene’s Captain Segura, Batista’s police chief.

Before leaving the mission for good at the end of my year there, I sent a note to Kofi Annan outlining the fraud, waste and abuse I had observed in MINURSO, and I offered to discuss it with him in New York on my return. His reply was that what I had told him was “not serious” (his words.) Once I had testified before our congress, my written testimony was picked up by the wire services and went all over the world. It was, for example, the cover story in the very popular journal Jeune Afrique. Once the media picked up the story, the Secretary General was, like Captain Renault in Casablanca, “shocked, shocked” to hear such things were going on in MINURSO and put his brand new inspector general on the case.
His inspection was a whitewash of the mission, as expected, but it was laughable, literally. John Bolton said at the time that had such a report been made by a federal inspector general, he would have been laughed out of town before the ink on his signature was dry.

For example, U.S. Army Colonel Dan Magee, who commanded U.S. troops in MINURSO, had complained that a senior mission official regularly demeaned his troops as “a bunch of thieves” because they were under whelmed by Morocco’s manipulating of the mission. Magee thought the U.N. Inspector General would be interested to hear about that kind of anti-American attitude. Magee was wrong. The Inspector General opined that since the official disparaged other nationalities as well, and was, therefore an equal-opportunity bigot, the Inspector General wasn’t interested. Incredible. But, as Casey Stengle used to say, “You could look it up.” Another MINURSO staffer, a Lebanese-American named Mara Hanna, upset by what she saw Morocco doing in the mission, was told by the Inspector General’s man: “If you answer my questions truthfully, you’ll never work for the U.N. again.” She did answer truthfully, and as she declared in the Rayburn House Office Building, she has been barred by the U.N. ever since.

The Security Council, under the leadership of Argentinean Ambassador, Emilio Cardenas, rejected the Inspector General’s Inspector Clouseau-like report within days of its appearance. According to The Washington Post, Ambassador Cardenas characterized the inspection report as “tall tales coming out of MINURSO.”

The reason the original inspection report was done so poorly was because, as the Inspector General himself later acknowledged, he really wasn’t allowed, under U.N. rules, to do a lot of inspecting. He was prohibited, for example, from looking into the possibility that Morocco was behaving badly in the referendum. Morocco, you see, is a member of the U.N., and the U.N. Inspector General was not allowed to risk embarrassing a member state by acknowledging misbehavior during the U.N. referendum. It was rather as if a special prosecutor in our country, in carrying out his investigation, were prohibited from investigating possible felonies by someone who holds a high post in the federal government because it might offend the person or the office being investigated. Absurd, but welcome to the U.N.

Human Rights Watch based in New York published its 38-page Report on MINURSO, and it is devastating, documenting blatant human rights violations and vote fraud carried out by Morocco right under the figurative nose of the mission. The mission and U.N., as expected, had no answer.

Perhaps the best example of business-as-usual at the U.N. was being invited, and then uninvited, to address the 4th Committee of the U.N. General Assembly. That’s the committee on COLONIALISM! The Committee follows Western Sahara because it is the world’s last colony. I consider it a badge pf honor to say that Boutros-Ghali, the man himself, personally intervened to see to it that the 4th Committee did not hear what I had to say about MINURSO. I was, I am told, the first person ever barred from speaking before that committee in the U.N.’s 60-year history. The Secretary General prevented the 4th Committee, composed entirely of member states of the U.N., from hearing someone who just might have been able to tell them the U.N. was wasting close to a billion dollars on a mission and referendum going nowhere.

One nice final touch about the U.N., about one quarter of whose expenses you and I and all of us U.S. taxpayers pay: When former U.S. Attorney General Dick Thornburgh was serving as Undersecretary for Management at the U.N., he submitted to Boutros-Ghali a report for streamlining the U.N., eliminating waste and fraud and saving hundreds of millions of dollars. Boutros-Ghali, as Thornburgh has stated publicly, had the report suppressed and the remaining copies shredded. (Fortunately, Dick kept copies.)

But I don’t want to leave on a misconception. Yes, I have been under-whelmed by the U.N., but despite all I have said here today, I am not anti-Morocco. Outside Western Sahara they may be our good ally. They even claim (erroneously) they were our first ally against the British. My problem with them is that in Western Sahara they invaded as illegally as Indonesia did in East Timor, and once there Morocco has behaved notoriously, without any fear of sanctions from our State Department.

It is sad for me as an American to see in those countries where I have served, in Equatorial Guinea and Western Sahara, that our government supports the thugs who run those places and ignores the good people who live there and want and deserve better. The United States has kowtowed to President Teodoro Obiang Mbasago of Equatorial Guinea. He is the brutal thief of his country’s patrimony and torturer of his own people, and quite literally a world-ranked dictator (He was # 9 at last reckoning), because he has a lot of oil to sell. Secretary of State recently received him at the State Department, calling him a great friend of the United States. Similarly, we have not confronted Morocco’s machtpolitik because Morocco is helpful in other areas. That explains why the otherwise insipid statement of David Welch, the State Department’s Secretary for the Near East, in June of this year, endorsed Morocco’s autonomy plan. Just following orders as someone once said. The late Daniel Patrick Moynihan, in his memoir as U.S. ambassador to the U.N. was more forthcoming. He acknowledged his job was to see that Western Sahara did not become an independent state, a charge, he said, he carried out very well. But that was during the Cold War, when Western Sahara had the wrong friends, and Henry Kissinger did not want another Angola on the west coast of Africa. The Cold War is long over.

I had great expectations when we had John Bolton at the U.N. He knew where the bodies were buried, and he is a no-nonsense lawyer who worked on the Baker Plan with Secretary Baker. If there were ever a reason to hope for real reform in the U.N. and for a just settlement for Western Sahara, John Bolton personified that hope. But unfortunately, John Bolton did not make policy. He carried it out like any honorable presidential appointee, and that policy tilted heavily in Morocco’s favor.

2007: THE PROSPECTS FOR A SOLUTION TO THE STALEMATE:

In mid-August, 2007, shortly before representatives of the Saharawi people and Morocco met on Long Island to discuss for the umpteenth time the future of Western Sahara, on this occasion the latest Moroccan autonomy plan, twenty-four members of the U.S. Congress sent a letter to President Bush. The letter urged the president “to take steps to ensure that your administration demonstrates respect for the rights of the Saharawi people to democratically choose their own political and economic future.” That statement goes to the very heart of the conflict in Western Sahara. The conflict is not really about an autonomy plan, the latest in a long line of illusions that Morocco has created over the years to distract world attention from the real issue: Morocco’s brazen land grab of Western Sahara, a land grab that stole from the people of Western Sahara, not only their homeland but also any say in their own future. Morocco’s crime was contemporaneous with and as flagrant a crime as Indonesia’s seizure of East Timor. It was part of what the British journal The Economist called a double Anschluss.

Facts are stubborn things, and despite Morocco’s efforts to hide them, they won’t go away. We have already mentioned the World Court’s opinion in the matter, a decision unfavorable to Morocco, and predictably Morocco ignored it and invaded. Despite dozens of U.N. Security Council resolutions since 1975 reaffirming the right of the Sahrawi people to self-determination, and despite the U.N.’s Committee on decolonization treating Western Sahara as a Moroccan colony, Morocco continues to put itself above the law and remains firmly in place, and in charge, in Western Sahara, Africa’s last colony. Anglo Saxon lawyers have an expression, res ipsa loquitur, the thing speaks for itself, that means in certain crystal clear situations, a simple recitation of the facts is sufficient, without more, to presume culpability. That is the case in Western Sahara.

The Moroccans now propose a limited autonomy plan for Western Sahara, under Moroccan supervision, of course. The Moroccan limited autonomy plan for Western Sahara might sound like a step forward, at least until you read the not-so-fine print. Article 6 of the plan provides that Morocco will keep its powers in the royal domain, especially with regard to defense, external relations and the constitutional and religious prerogatives of his majesty the king. In other words, the Moroccans are offering autonomy, except in everything that counts.

It gets even more disingenuous. The Moroccans say their plan will be submitted to a referendum, but a referendum to be voted on by whom? By the Moroccan people? That would be absurd on the face of it. By the Saharawis themselves? If so, what happens if the Saharawis reject the plan? Will that mean Sahrawi independence? You can be sure the Moroccans would never tolerate that result. The only referendum worth considering is one the Sahrawis can endorse, that is, where all the options are on the table. That’s not in the cards. Anything less is a sham.

The history of the conflict is downright discouraging to anyone who believes in the rule of law. Voltaire, who had little faith in an international legal system, said in so many words after reviewing the most famous international law treatise of his day, Vattel’s Droit des Gens: “An international law for nations? Next they’ll be talking about a code of conduct for highway robbers and gangsters!” And things have not changed all that much in our day. Morocco has behaved unconscionably since its invasion of Western Sahara because it has tremendous internal political pressures to do just that. Those same domestic political pressures require spending billions of dollars since this conflict began to eliminate the possibility of an independent state to their south.

To recoup the extraordinary costs of their aggression, Morocco attempted, among other things, to exploit whatever oil resources exist off the coast of Western Sahara until, in 2002, the U.N. legal advisor, Hans Corell, stepped in to say that “…the exploration and plundering of the marine and other natural resources of colonial and non-self governing territories by foreign economic interests, in violation of the relevant resolutions of the of the United Nations, is a threat to the integrity and prosperity of these territories.” Translated from legalese, Morocco, as an occupying power but not the Administering power, must stop plundering the natural resources of Western Sahara.

Nothing deterred by this chastisement, Morocco recently entered into the European Union-Moroccan Fisheries Agreement whereby the EU pays Morocco an enormous amount of money to permit 119 EU member vessels to fish Morocco’s Atlantic waters, including those off Western Sahara. Here, for once, Morocco is not acting alone in the theft of Western Sahara’s natural resources; it is part of a conspiracy with the EU. This is business as usual for Morocco, but unfathomable for the EU that has to know its action flies in the face of the Corell declaration of the inviolability of Western Sahara’s natural resources.

Western Sahara is currently recognized by 70 countries, although Morocco has been attempting by strong arm tactics to intimidate some of the smaller countries to withdraw their recognition. Western Sahara is also a full member of the African Union, the successor to the Organization of African Unity. These facts alone would seem to demand forbearance by the EU, but such was not the case.

Despite all the diplomatic bloviating at the U.N. and Washington and elsewhere about the rights of people everywhere to self-determination, the countries that could make a difference in Western Sahara are willing to jettison the rights of one small nation to determine its future to placate Morocco and its outrageous irredentist demands. When the Germans invaded Czechoslovakia 70 years ago, Prime Minister Neville Chamberlain acquiesced to Germany’s need for lebensraum. Plus ca change…

Fortunately for everyone interested in justice for Western Sahara, your Council now enters the debate over this conflict. Your work in arranging this presentation goes a long way to putting Western Sahara on the geo-political map for those unfamiliar with the issues, and for the rest of us, it explains why this 30 year old conflict is so important, not only to the Saharawis but to the great powers. It also emphasizes why Western Sahara is not a sideshow to be patronized by the U.N. as it concentrates on other hot spots in the world.

After the September 11 terrorist attacks in New York, people all over the world said: “We are all New Yorkers now.” Through conferences like this one, I would hope that some day we might hear some one say: “We are all Saharawis now.”

MADRID, Spain: A leading Spanish anti-terrorism judge is to open an inquest into suspected atrocities committed against North African Saharawi people, a court statement said Tuesday.

The offenses, which include genocide, assassination, injury and torture, are believed to have taken place in the mid-1970s, when Spain withdrew from its former colony of Western Sahara, a statement by National Court judge Baltasar Garzon said.

Spain abandoned the territory following the death of dictator Francisco Franco in 1975 and Morocco then invaded.

"An attempt at genocide did happen and this inquest is important because the Saharawi people ask for justice," said Mohamed Sidati, Polisario Front Minister-Delegate for Europe. The Polisario Front supports self-determination for the Saharawi people.

Garzon is to probe whether sufficient evidence exists to prosecute 13 Moroccan citizens suspected of having carried out crimes during and after the territorial annexation.

"It's time the Saharawi people's fate was finally talked about," said Jose Taboada, a support group spokesman.

Spain's so-called universal justice principle — established by the National Court in 1998 — allows courts here the legal right to prosecute crimes alleged to have been committed in other countries.

Garzon used it in a vain attempt to try former Chilean dictator Augusto Pinochet for genocide and other crimes in his country. Britain, which had arrested Pinochet in London on a Spanish warrant, declined to extradite Pinochet, citing his poor health.

The principle, part of a growing body of international law, also underpinned a trial in Madrid that convicted Imad Yarkas, a suspected al-Qaida cell leader.

Yarkas was sentenced to 27 years in prison for conspiracy and heading a terrorist organization linked with the Sept. 11, 2001 attacks in the United States.

Garzon has called witnesses to begin giving evidence on Dec. 11-12, the statement said.

Several previous inquests into suspected crimes against the Saharawi people have been shelved for lack of evidence said Maria Jose Fisac, a lawyer linked to Saharawi legal cases.

ANTECEDENTES

PRIMERO.- En fecha 14 de septiembre de 2006 se presentó querella por el Procurador Domingo José Collado Molinero en nombre y representación de D. Ali Omar Buzeid y otros por un delito de genocidio en relación concursal con asesinatos, lesiones y torturas contra Dris Bsri, Abdelasis Bannani, Husni Ben Sliman, Abdelhak El Kadiri, Yassine Mansouri, Abdelhafid Ben Hachem, Hamidou Lanigri, Ben Hima, Taifi, Abdelhak Lemdaour, Hamdaoui, Lamarti, Ben Otman, Douib Hamid, Amimi, Issaoui, Idris Sbaia, Ayachi, Ahmed Gareb, Said Oissou, Garouani Mohamed, Brahim Ben Sami, Hariz Larbi, Ahmed Jtaitou, Asis Amrani, Abderrahim Taifi, Rouimi Ayad, Mohamed Arsalan, Allabouch, Goufili Mohamed, Sanhaji, M. Ouazani. Tras los oportunos trámites, se dio traslado al Ministerio Fiscal para que informara sobre jurisdicción y competencia.

SEGUNDO.- El Ministerio Fiscal, informó que procedía aceptar la competencia para averiguar los hechos objeto de la querella, pudiendo ser los hechos relatados en ella constitutivos de un delito de genocidio, establecido en el artículo 2 del Convenio para la Prevención y la Sanción del Delito de Genocidio y un delito de torturas.

TERCERO.- El Juzgado decidió que, previamente a la decisión sobre la admisión de la querella, se subsanaran determinadas deficiencias procesales y de concreción mínima de hechos que se imputan a cada uno de los querellados y presunta participación de éstos con los hechos imputados.

CUARTO.- Con el escrito presentado el 23 de octubre de 2007 los querellantes, han dado cumplimiento a las diligencias requeridas por el Juzgado.

HECHOS

PRIMERO.- Las personas contra las que se concreta la acción penal, una vez que se ha hecho la concreción anterior, son:

SEGUNDO.- Los imputados y los hechos enmarcados en una acción compleja y sistemáticamente organizada, contra personas saharauis, y en función de esta cualidad, que son objeto de querella y de investigación, son, entre otros:

- HOUSNI BEN SLIMAN, fue el superior que ordenó y dirigió presuntamente la campaña de detenciones y posteriores desapariciones en Smara en el año 1976; entre otros, fue el causante de la desaparición de Mohamed Salem Uld Hamdi.

- ABDELHAFID BEN HACHEM, habría secuestrado el 20 de noviembre de 1987 a Djimi El Ghalia Abdalajhe dando la orden de torturarla; así mismo sería el responsable directo de los secuestrados en 1987 en El Aaiún, y el supervisor de los interrogatorios con prácticas de tortura y tratos degradantes.

- BEN HIMA habría participado en la reunión mantenida por altos dirigentes en casa del gobernador de El Aaiún en febrero-marzo de 1988, en la que Ben Hachem presuntamente ordenó torturar a Djimi El Ghalia Abdalajhe.

- ABDELHAK LEMDAOUR habría sido el responsable y dirigente de una gran campaña de detenciones, entre ellas la de El Habla Lahbib Abdelah y de Safia Mohamed Lamin Dadach, que tuvo lugar el 12 de julio de 1976 en la zona de Erbaib, cerca de Smara, en la que se que saqueó las casas de sus habitantes y posteriormente se torturó a los detenidos; presuntamente fue el responsable de la detención y desaparición de Mohamed Salem Uld Hamdi el 10 de julio de 1976.

- MOUSTAFA HAMDAOUI, responsable y dirigente del Cuartel de la Gendarmería en Tan Tan, habría torturado a Zaigham Saleh, detenido el 17 de enero de 1981 en Tan Tan, perteneciente al "Grupo de los 6".

- AMIMI, habría participado en la detención de Safia Mohamed Lamin Dadach y El Habla Lahbib Abdelah el 12 de julio de 1976, los cuales fueron posteriormente torturados durantes su detención.

- DRIS SBAI o "IDRIS SBAIA" presuntamente comandaba las operaciones de detenciones, secuestros e interrogatorios y torturas junto con el coronel Abdelhak Lemdaouar contra ciudadanos saharauis. Habría participado en la detención y tortura de El Habla Lahbib Abdelah y Safia Mohamed Lamin Dadach el 12 de julio de 1976 y sería el responsable de la detención y desaparición de Mohamed Salem Uld Hamdi.

- AYACHI presuntamente participó en detenciones ilegales siguiendo las órdenes del general Bdelhak Lemdaouir y sería responsable de la detención y tortura de Djimi El Ghalia Abdalajhe el 20 de noviembre de 1987.

- SAID OUASSOU o "SAID OISSOU", habría sido el responsable directo de todas las detenciones de ciudadanos saharauis que tuvieron lugar en El Aaiún entre 1976 y 1978 y habría participado en la detención y tortura de Bachir Azman Housein.

- BRAHIM BEN SAMI, presuntamente participó en la detención y tortura de Djimi El Ghalia Abdalajhe el 20 de noviembre de 1987.

- HARIZ EL ARBI formó parte de la brigada criminal en El Aaiún, que presuntamente se ocupaba de torturar a los presos civiles saharauis; en los años ochenta y noventa habría dirigido este grupo de torturadores. Entre sus víctimas estarían Fatimetou Ahmed Salem Baada, detenida el 4 de abril de 1984 y actualmente desaparecida, Djimi El Ghalia Abdalajhe en cuyo secuestro presuntamente participó el 20 de noviembre de 1987 y Mahmud Mohamed Salem Bachir (El Aayachi), detenido y torturado en dos ocasiones en las fechas 12 de noviembre de 1979 y 14 de octubre de 1983.

- ABDELAZIZ ALLABOUCH, habría participado en la detención y tortura de Djimi El Ghalia Abdalajhe el 20 de noviembre de 1987.

- SANHAJI HAMID presuntamente asistió a todas las escenas de tortura de los presos políticos saharauis durante toda su época de trabajo en El Aaiún y habría participado en la detención y tortura de Djimi El Ghalia Abdalahe el 20 de noviembre de 1987.

RAZONAMIENTOS JURIDICOS



PRIMERO.- No estando determinadas la naturaleza y circunstancias de los hechos denunciados ni las personas que en ellos han intervenido, es procedente, de conformidad con lo dispuesto en los artículos 774 y 777 de la Ley de Enjuiciamiento Criminal, incoar Diligencias Previas y practicar aquellas esenciales encaminadas a efectuar tal determinación y en su caso, el procedimiento aplicable.

SEGUNDO.- De acuerdo con lo establecido en el art. 23.4 de la LOPJ, el principio de justicia penal universal, la Sentencia del Tribunal Constitucional de 26 de septiembre de 2005, el artículo 65 de la LOPJ, el art. 14 y concordantes de la LECrim, artículos 163,166, 173 y 607 del Código Penal y Tribunal Europeo de Derechos Humanos, procede admitir la competencia de este Juzgado, incoar el correspondiente procedimiento penal para iniciar la investigación y concreción de hechos, responsabilidades, y si existe o no procedimiento o causas abiertas en Marruecos contra las personas mencionadas, por los hechos objeto de querella.



En atención a lo expuesto:

DISPONGO



ACEPTAR la competencia para la instrucción de los hechos denunciados y presunto delito de genocidio y torturas, INCOÁNDOSE Diligencias Previas, que se registrarán con el número de orden que proceda y dando cuenta de su incoación al Ministerio Fiscal.



PRACTICAR las siguientes diligencias:

- Ratificar el escrito presentado por quienes se dirá, sirviendo asimismo la comparecencia para recibirles declaración sobre los hechos denunciados. A tales fines, se señala, respecto de ALI OMAR BUZEID y HOURIA AHMED LAMMAADAL el próximo día 11 de diciembre de 2007 y hora de las 10 de su mañana, y respecto de FETIMEOTU MOUSTAPHA SALEMH –a la que en este momento procesal se tiene por querellante y acusación particular- y OMAR HEIBA MEYARA –y no como por error se hizo constar en la querella Lehdia Eli Bofia Meira-, el próximo 12 de diciembre de 2007 y hora de las 10 de su mañana, quedando citados con la notificación de este proveído a su representación en autos. En cuanto a la práctica de dichas diligencias respecto a Mohamed Salem Luanar Aomar estese a la presentación por el Procurador Sr. Collado Molinero de poder que acredite su representación.



- Librar Comisión Rogatoria a las autoridades judiciales del Reino de Marruecos a fin de que :



a) Se dé traslado y notifique la querella y documentos presentados a cada uno de los querellados informándoles de que se pueden mostrar parte en esta causa.



b) Informe a este Juzgado sobre si los hechos que se recogen en la querella fueron o están siendo investigados y cuál fue el resultado de la investigación. Se deberá remitir copia testimoniada de las actuaciones realizadas.



c) Si existe o ha existido procedimiento penal contra los querellados por estos hechos en Marruecos.



d) Los datos que consten a nivel oficial sobre la identidad de las víctimas y lugar de inhumación.



Esta resolución no es firme y frente a ella cabe recurso de reforma ante este juzgado, que ha de interponerse en el plazo de TRES días.

الرباط ـ القدس العربي ـ من محمود معروف:لم تحمل تصريحات الرئيس الفرنسي نيكولا ساركوزي التي ادلي بها اثناء زيارته للرباط أي جديد في موقف بلاده حول نزاع الصحراء الغربية وان كانت اكثر وضوحا في تأييده للمقاربة المغربية لتسوية النزاع.لكن هذه التصريحات اثارت قلق جبهة البوليزاريو التي دأبت علي اتهام باريس بالانحياز للاطروحة المغربية خاصة منذ تقديم الرباط مبادرة منح الصحراويين حكما ذاتيا تحت السيادة المغربية كحل دائم ونهائي للنزاع المتفجر منذ منتصف سبعينات القرن الماضي. الرئيس نيكولا ساركوزي وفي خطاب القاه امام البرلمان المغربي اعرب عن الأمل في أن يشكل مخطط الحكم الذاتي الذي اقترحه المغرب أساسا للمفاوضات لإيجاد تسوية معقولة لقضية الصحراء.وأكد الرئيس الفرنسي أن مخطط الحكم الذاتي المغربي موجود، وهو علي طاولة المفاوضات ويمثل مقترحا جديدا بعد مأزق دام عدة سنوات، وآمل أن يشكل قاعدة للمفاوضات علي درب إيجاد تسوية معقولة لقضية الصحراء وقال فرنسا ستكون إلي جانبكم . وأضاف أن مغرب اليوم هو أيضا مقاربة جديدة للصحراء الغربية. وأنا لأتحمل مسؤولياتي كرئيس للدولة عندما أقول: إن المغرب اقترح مخططا للحكم الذاتي جديا وذي مصداقية كأساس للمفاوضات .ولعبت فرنسا دورا اساسيا في تشجيع المغرب علي تقديم مبادرة يمكن ان تشكل ارضية للمفاوضات للخروج بحل سلمي للنزاع وتقول اوساط دبلوماسية ان باريس ساهمت بصياغة المقترح المغربي الذي قدم في نيسان (ابريل) الماضي الي مجلس الامن الدولي والذي يعتبره المغرب الحل الوحيد المقبول للنزاع.وقال الرئيس نيكولا ساركوزي إن المخطط يمثل بالنسبة لفرنسا حلا سياسيا، متفاوضا بشأنه ومقبولا من الطرفين تحت رعاية الأمم المتحدة، سيمكن من تسوية هذا النزاع الذي طال أمده . ووصفت جبهة البوليزاريو تصريحات الرئيس الفرنسي بـ الخطيرة و غير المواتية .واكدت في بلاغ بثته وكالة الانباء الجزائرية ظهر امس الاربعاء ان تصريحات الرئيس الفرنسي خطيرة كونها تتجاهل كافة اللوائح الاممية التي تقر الحق الثابت للشعب الصحراوي في تقرير المصير والاستقلال وتشكل تشجيعا للتعنت و تحيزا لموقف المحتل المغربي الذي يحاول دون جدوي تبرير الامر الواقع الذي يريد فرضه ضاربا بالمبادئ الاساسية للديمقراطية عرض الحائط . واضافت ان هذه التصريحات غير مواتية كونها تأتي في الوقت الذي يوجد فيه مسار المفاوضات بين جبهة البوليزاريو والمغرب الذي يشرف عليه الامين العام للامم المتحدة ومبعوثه الشخصي في مرحلة تلزم اعضاء مجلس الامن بلعب دور ايجابي من خلال مساعدة طرفي النزاع علي المضي قدما بغية ايجاد حل يضمن حق الصحراويين في تقرير المصير طبقا للقرار 1754 الذي اصدره مجلس الامن الدولي في نيسان (ابريل) الماضي.واعربت الجبهة عن اسفها لهذه التصريحات التي وصفتها بالانحياز للمغرب الذي اتهمته بافشال كافة الجهود الحميدة التي تبذلها المجموعة الدولية من اجل حل النزاع ولكون الرئيس الفرنسي الجديد يواصل انتهاج سياسة بالية تتنافي بشكل صارخ مع تصريحات النية حول اتحاد المغرب العربي والاتحاد المتوسطي كما أنها تضر بالمصالح الاستراتيجية لفرنسا .الطيب الفاسي الفهري وزير الخارجية المغربي قال أن دعم فرنسا للمبادرة المغربية للحكم الذاتي يندرج في إطار الأمم المتحدة وقرارات مجلس الأمن .وأوضح الفاسي الفهري أن الأمر يتعلق بـ دعم سياسي لأن فرنسا تعرف المنطقة، وحيثيات وملابسات قضية الصحراء .وأضاف نحن سعداء لكون الدينامية التي خلقتها المبادرة المغربية للحكم الذاتي لم تحظ فقط بدعم بلد هام ضمن أعضاء مجلس الأمن، ولكن أيضا بدعم شركاء دوليين آخرين .وتأتي تصريحات نيكولا ساركوزي في وقت يستعد فيه مجلس الامن الدولي لدورة نقاشات حول تطورات نزاع الصحراء الغربية يقدم خلالها الامين العام للامم المتحدة تقريرا حول هذه التطورات من نيسان (ابريل) الماضي الي الان والتي شهدت جولتين من المفاوضات بين المغرب وجبهة البوليزاريو تحت رعاية الامم المتحدة في مانهاست احدي ضواحي نيويورك في حزيران (يونيو) واب (اغسطس) الماضي ومن المتوقع استئناف الجولة الثالثة في كانون الاول (ديسمبر) القادم في جنيف.وطلب بان كي مون بتقريره مجلس الأمن بدعوة المغرب و جبهة البوليزاريو إلي الدخول مجددا في مفاوضات حقيقية حول مسألة الصحراء الغربية وضمان تطبيق فعلي للقرار 1754 الذي دعا طرفي النزاع الصحراوي الي الدخول في مفاوضات بحسن نية و دون شروط مسبقة مع الأخذ بعين الإعتبار التطورات التي طرأت خلال الأشهر الأخيرة قصد التوصل إلي حل سياسي عادل و دائم و مقبول من كلا الطرفين بشكل يسمح للشعب الصحراوي بتقرير مصيره . وبخصوص العلاقات القائمة بين الطرفين ميدانيا أكد بان كي مون أنه علي عكس ما كنت أشير إليه في تقاريري الأخيرة للمجلس فإنه لم يتراجع عدد انتهاكات الاتفاق العسكري الذي يحدد شروط وقف إطلاق النار . وسجل أن القيود ما برحت تعرقل حرية تنقل المراقبين العسكريين التابعين للأمم المتحدة عند رغبتهم في التوجه إلي وحدات أو مقرات رئيسية أو نقاط إسناد قصد التحقق .وصرح بان كي مون أن البعد الإنساني للنزاع لاسيما مصير لاجئي الصحراء الغربية لا يزال مقلقا معربا عن ارتياحه لاستئناف تبادل الزيارات العائلية دون توقف خلال الفترة المذكورة الا ان تقارير تحدثت عن توقف هذه الزيارت اذا لم تتوفر الميزانية اللازمة لذلك.ودعا الامين العام للامم المتحدة في تقريره المغرب وجبهة البوليزاريو الي الالتزام بالحوار المستمر و البناء مع المحافظة السامية لحقوق الإنسان بغرض ضمان احترام حقوق الإنسان للصحراويين . وأضاف أنه علي الرغم من كون المينورسو (قوات الامم المتحدة المنتشرة بالصحراء الغربية) ليست مخولة ولا تتوفر علي الموارد من اجل التكفل بهذه المسألة بيد أن منظمة الأمم المتحدة تبقي عازمة علي فرض احترام المعايير الدولية في مجال حقوق الإنسان .وتقول جبهة البوليزاريو ان سياسات دول مثل فرنسا جعلت المغرب يستفيد من العقاب التام والسماح لنفسه بالاستمرار في ارتكاب جرائم الحرب والانتهاكات الصارخة لحقوق الانسان في الصحراء الغربية . ويقول ناشطون صحراويون ان السلطات المغربية منعتهم من تأسيس منظمة صحراوية للدفاع عن حقوق الانسان. وقالت مصادر صحافية ان السفارة الامريكية ابلغت السلطات المغربية انزعاجها من هذا المنع وطلبت بتسهيل تأسيس منظمات مجتمع مدني صحراوية كون ذلك ينسجم مع مقاربة المغرب بمنح المنطقة حكما ذاتيا ولا يتناقض معها.وقضت محكمة الدرجة الأولي بمدينة العيون (كبري حواضر الصحراء) الإثنين الماضي ببراءة ناشطين من الجمعية الصحراوية لضحايا الانتهاكات الجسيمة لحقوق الإنسان المرتكبة من طرف الدولة المغربية.وقالت الجمعية في بلاغ ارسل لـ القدس العربي ان المحكمة قضت ببراءة كل من إبراهيم الصبار واحمد السباعي وهما المسؤولان في الجمعية بالاضافة الي المعتقلين السياسيين أحمد سالم أحميدات ومحمد الحبيب القاسمي وعبد السلام اللومادي.وكان هؤلاء قد اتهموا من قبل المحكمة بإهانة رجال القضاة. هذه التهمة قالت الجمعية انها جاءت في تعميم من وزارة العدل المغربية لإجبار السجناء الصحراويين علي عدم ترديد الشعارات السياسية المتعلقة بحق الشعب الصحراوي في تقرير المصير .في سياق محاكمات أعضاء الجمعية الصحراوية أحالت المحكمة الابتدائية لمدينة العيون ، لمداولات يوم الاربعاء القادم قضية عضو المكتب التنفيذي بلاهي الصديق المتابع بتهمة تكوين جمعية غير مرخص لها. ومن المقرر ان يمثل كل من خليهنا الشيخ علي الدليمي ومحمد احمد بركوه وهم وحميد أحمد بركوه المعتقلون بمدينة السمارة شهر حزيران (يونيو) الماضي امس الخميس أمام محكمة الدرجة الأولي بالمدينة.

جبهة البوليساريو تعرب عن ارتياحها إزاء المواقف المسجلة في تقرير بان كي مون حول الصحراء الغربية

تلقت جبهة البوليساريو بارتياح تقرير الأمين العام للأمم المتحدة رقم (S/2007/619) الذي يعالج بشكل معمق الأوجه السياسية والإنسانية والعسكرية وقضايا حقوق الإنسان المتعلقة بمسالة الصحراء الغربية، والذي يقدم قاعدة مستوفية تمكن مجلس الأمن من تقييم ايجابيات مأموريته في تطبيق التوصية 1754 .

وأوضح عضو الأمانة الوطنية، المنسق الصحراوي مع المينورسو، السيد أمحمد خداد في تصريح لوسائل الإعلام بعيد نشر تقرير الأمين العام حول الصحراء الغربية ، "أن سكرتير عام الأمم المتحدة قد ذكر وبقوة بالفرصة التي يتيحها تطبيق اللائحة 1754 في نصها وروحها عبر المفاوضات وبحسن نية ودون شروط مسبقة من اجل التوصل إلى حل سياسي عادل دائم ومقبول من الطرفيين يمكن من تقرير مصير شعب الصحراء الغربية ."

وأضاف ولد خداد أن "هذا التقرير يتيح مساهمة مهمة لخلق الشروط لنجاح المفاوضات بين جبهة البوليساريو والمغرب وبطريقة جد واضحة كون المفاوضات تجري بين طرفي النزاع وعلى قاعدة المقترحين وعلى قدم وساق، بذات الصدد فان الأمين العام ومبعوثه الشخصي يشطبان بطريقة واضحة المزاعم والدعاية المغربية الهادفة لجعل أطروحتها قاعدة وحيدة ونهائية في المفاوضات" .

إن جبهة البوليساريو التي تجاوبت إيجابا مع دعوة المبعوث الشخصي للامين العام الاممي لعقد جولة ثالثة من المفاوضات خلال النصف الثاني من شهر نوفمبر المقبل تدعم وبقوة مطالبة الأمين العام ومبعوثه الشخصي بخصوص سير جولة المفاوضات بما فيها ما تعلق بالمباحثات وتبني اجراءت الثقة بين طرفي النزاع .

وختم الدبلوماسي الصحراوي تصريحه لوسائل الإعلام بالقول "أن جبهة البوليساريو تعرب عن ارتياحها الكامل كون الأمين العام الاممي قد أولى أهمية في تقريره للوضعية الخطيرة لحقوق الإنسان في الأراضي المحتلة من الصحراء الغربية، هذا الانطباع من لدن الأمين العام يريد منه الدعوة لجميع المؤسسات في الأمم المتحدة إلى أن تولي بدورها الأهمية اللازمة لهذه الوضعية، كما أنها تشكل حثا لأعضاء الأمم المتحدة لممارسة الضغوط الضرورية إزاء المغرب لحمله على وقف قمعه والانتهاكات غير المقبولة لحقوق الإنسان في الصحراء الغربية "

تقرير الامين العام حول الوضع في الصحراء الغربية أكتوبر 2007
I - مقدمة:
1- إن هذا التقرير يتبع لقرار مجلس الامن 1754 ( 2007 ) الصادر في 30 أبريل 2007 والذي بموجبه تم تمديد عهدة بعثة الامم املتحدة للاستفتاء في الصحراء الغربية ( مينورسو ) حتى 31 أكتوبر 2007.
وفي ذلك القرار، طلب مجلس الامن من الامين العام تقديم تقرير عن الوضع في الصحراء الغربية قبل إنتهاء العهدة المذكورة وهذا التقرير يتطرق للتطورات منذ صدور تقريري الصادر في 13 أبريل 2007 ( S/2007/ 202 ).
II- التطورات الاخيرة في الصحراء الغربية:
2- في 30 يوليو، وفي خطاب له بمناسبة تخليد الذكرى الثامنة لتوليه العرش، قال الملك المغربي محمد السادس أن المغرب مستعد للتفاوض حول حل مبني على أسس حكم ذاتي متفق عليه ضمن سيادة المملكة.
3- في السابع من سبتمبر 2007 ، تم إجراء إنتخابات برلمانية في المغرب،والتي تضمنت التصويت في المناطق التي يديرها المغرب من الصحراء الغربية. وقد كاتبني ممثلو الجبهة الشعبية لتحرير الساقية الحمراء ووادي الذهب في 19 أغسطس 2007 ولاحقا في 09 سبتمبر 2007 يدينون تصرف الحومة المغربية في تنظيم هذه الانتخابات في الصحراء الغربية، ومطالبين بالمقابل بتنظيم تصويت حر ونزيه حول تقرير المصير لشعب الصحراء الغربية.
III – أنشطة ممثلي الخاص:
أ/ حالة وتطور المفاوضات:
4- تتضمن هذه الفقرة من التقرير حالة وتطور المفاوضات بشأن الصحراء الغربية منذ تقريري الصادر في 29 يونيو 2007 ( S/2007/385 ). في قراره 1754( 2007 )، طلب مجلس الامن من الطرفين الدخول في مفاوضات مباشرة بدون شروط مسبقة وبحسن نية اخذين بعين الاعتبار التطورات الحاصلة في الاشهر الاخيرة، من أجل التوصل الى حل عادل ودائم ومتفق عليه يفضي الى تقرير مصير شعب الصحراء الغربية. وكذلك طلب التقرير مني أن تكون هذه المفاوضات تحت رعايتي.
5- ولتنفيذ قرار مجاس الامن 1754( 2007) تم إجراء الجلسة الاولى من عملية المفاوضات في منتجع كرين تري بمنهاست/ نيويرك في 18-19 يونيو 2007 ، وهو ما ورد في تقريري الصادر في 29 يونيو 2007 ( 385/2007/S ). وفي تلك الجولة الاولى من المحادثات وافق الاطراف على بيان أعده ممثلي الخاص يشير الى أنه وخلال اللقاء تم إجراء المفاوضات طبقا لقرار مجلس الامن 1754 ( 2007 )، وأتفق الطرفين على مواصلة المفاوضات في جولة أخرى تجرى في مانهاست في الاسبوع الثانيمن أغسطس 2007.
6- وكما تم الاتفاق عليه إلتقى الطرفين ثانية في منتجع قرين تري بمانهاست بتاريخ 10-11 أغسطس 2007 . وقدحضرت أيضا كل من الجزائر وموريتانيا بصفتهما بلدين مجاورين.وفي الجلسة الافتتاحية، قدم الطرفين وجهتي نظرهما التي عبرا فيها عن إلتزامهما بالتعاون مع الامم المتحدة لتطبيق قرار مجلس الامن 1754 ( 2007 ).ورغم تأكيدهما على إحترام مبدأ تقرير المصير وقبولهما لقرار مجلس الامن 1754 ( 2007 ) القاضي بالتفاوض فإن موقفيهما بقيا متباعدين جدا بخصوص تعريف ( تحديد معنى ) تقرير المصير.
7- وبعد الجلسة الافتتاحية تم تبادل لوجهات النظر بخصوص تنفيذ قرار مجلس الامن 1754 ( 2007)، ثم إستمع الطرفين الى تقديم لخبراء من الامم المتحدة وشاركوا في مناقشات حول مواضيع تتعلق بالثروات الطبيعية والادارة المحلية، كما أجريا محادثات منفصلة مع مبعوثي الشخصي. وفي النهاية وبمبادرة من مبعوثي الشخصي طلب من الطرفين وضع الاعتبار تعديل ( توسيع ) محتمل لاجراءات بناء الثقة الحالية ( CBMs ). وفي جواب على المبادرة أشار وفد جبهة البوليساريو الى رضا الجبهة عن إجراءات بناء الثقة التي تم تنفيذها وعن بقائها متفتحة على اي تعديل إضافي وفقا للاستشارة الدولية. وقد شكر الوفد المغربي مبعوثي الشخصي على مبادرته التي يعتبر موضوعها هاما جدا بالنسبة لشعب المنطقة، إلا أنه أضاف أن موضوع إجراءات بناء الثقة تم تناوله ضمن الاطار الذي حددته المفوضية السامية لشؤون اللاجئين التابعة للامم المتحدة المعنية بالموضوع والتي يجب أن تبقى المعني الاساس بتعديل وتقديم هذه الاجراءات، وانه بوضع في الاعتبار مقترح محتمل بخصوص إجراءات بناء الثقة التي هي من إختصاص هذه الهيئة، فعليه يجب إيجاد هيئة أخرى تعني بالموضوع.
8- وخلال اللقاء عبر الطرفين عن موافقتهما على بيان مبعوثي الشخصي المحتوى في المحلق رقم 01 من هذا التقرير والذي عبرا من خلاله عن أن الوضعية الراهنة غير مقبولة وعن إلتزامهما بمواصلة المفاوضات بحسن نية.
9- منذ ذلك الحينن وللاسف، لم يكن من الممكن تحديد تاريخ متفق عليه لمواصلة المفاوضات، وبما أن إلتزام الطرفين بمواصلة التفاوض بنية حسنة لالبس عليه، فإن مبعوثي الشخصي سخر نفسه إبان تلك الفترة لإيجاد الطرق التي تشجع الطرفين على الدخول في مفاوضات أكثر واقعية من التي تم إجراءها في الجولتين السابقتين.

10- في بيانه ( ملحق رقم 01 )، أعلن مبعوثي الشخصي أنه تم إجراء محادثات واقعية تفاعل فيها كل من الطرفين مع الاخر وعبرا عن وجهتي نظريهما. وبالرجوع الى ما مضى فقد يبدو أن هذا تقييم وردي للجولة الثانية لانه كذلك طبع اللقاء ثانية بأجواء حسنة وتصرفات متزنة، وأظهر أيضا نفس المواقف الصلبة. وبسبب هذه المواقف، وللاسف، فغن اللقائين الاولين جملة، لم يفضيا الى تنفيذ الفقرة الثانية من قرار مجلس الامن 1754 ( 2007 ) لانه لا يمكن التأكيد على أن الطرفين دخلا في المفاوضات، ولا يعود ذلك الى غياب النية الحسنة لديهما بل يعود أولا الى معضلات سابقة في تفسير دعوة مجلس الامن لهما بالدخول في مفاوضات بدون شروط مسبقة. وتقريبا مع مطلع العام الماضي،في تقرير الامين العام 16 أكتوبر 2006 ( 817/2006/S الفقرتين 18-19 ) فقد إنصب إهتمام مجلس الامن على التمييز الواضح بين الشروط المسبقة والمواقف الجوهرية: فلايمكن قبول لا وجهة النظر المغربية ( أنه يجب الاعتراف له بالسيادة على الصحراء الغربية) ، ولا تلك التي لدى البوليساريو ( أن الوضعية النهائية للاقليم يتم تحديدها من خلال إستفتاء يتضمن خيار الاستقلال)، لا يمكن قبولهما كشروط مسبقة، لكنهما يعتبران بمعرفة الجميع المواقف الجوهرية للطرفين. وخلال التحضير للمحادثات في يونيو لم يتم التعامل مع وجهتي النظر هاتين على أنهما شروط مسبقة: فكلا الطرفين كان مستعدا للجلوس الى طاولة التفاوض دون وضع أمامه موقفه الجوهري. وعليه بدا ظاهريا أن كل شئ على يرام، ولكن وبما أن هذه المواقف الجوهرية لدى كل طرف مقصاة لدى الاخر، فقد منعت كل طرف من مناقشة مقترح الطرف الاخر. وكنتيجة لذلك، فإن الطرفين _ في الواقع _ عبرا عن وجهتي نظريهما وكذا تفاعل كل منهما مع الاخر، ولكنهما قاما بذلك مع رفض وجهة نظر الطرف الاخر، ولذا كان من الصعب إيجاد اي تعاطي يمكن أن يوصف بالمفاوضات.
11- رغم حقيقة أن لقائين تم إجراءهما يعتبران مدعاة للرضا، فإن مبعوثي الشخصي قلق بخصوص صعوبة تنفيذ قرار تبناه مجلس الامن بالاجماع، والذي أشيد به ووصف عند تبنيه بكسر الجمود في التعامل مع مسالة الصحراء الغربية. وفي البيان المشار اليه أعلاه الصادر عقب اللقاء الثاني، اشار الطرفين الى أن الوضعية الراهنة غير مقبولة. ولكن وإلى حد الان فإن هذا التصنيف كان مرده مأزق إما المفاوضات الوضعية الراهنة، ونحن الان نواجه خطر الدخول في مرحلة طويلة الامد من المفاوضات في نفس الوضعية.
12- وقبل تناول ما يجب القيام به لتجاوز ذلك، يرغب مبعوثي الشخصي في عرض التعليقات المختصرة التالية بخصوص عناصر اللقاء الثاني والتي لم تكن ذات علاقة مباشرة لمقترحات الطرفين. لكي يتم تجاوز ووضع حد نهائي لتكرار تشبث الطرفين كل بموقفه، وفي نفس الوقت المساهمة في خلق جومن الثقة، فإن الموضوعين المشار اليهما أعلاه في الفقرة 7 ( الموارد الطبيعية والتسيير المحلي ) تمت إضافتهما لجدول أعمال اللقاء الثاني. وقد نجح ذلك الى حد ما: المحادثات سارت بشكل جيد، وشارك فيها كل طرف بفاعلية، إلا أنه وبشكل عام تم التوصل الى أن هذه المسائل التقنية لايمكن أن تحل محل المفاوضات الفعلية الهادفة الى حل سياسي مقبول ومتفق عليه، والذي طالب به القرار 1754 ( 2007 ).
13- وتمت إضافة موضوع اخر لجدول الاعمال، وهو تدابير بناء الثقة، والمذكور في الفقرة 7 من هذا التقرير، وبما أنه تم تناول ذلك بإيجاز في مانهاست فإن مبعوثي الشخصي ينوي إثارة الموضوع ثانية في الجولة المقبلة للحصول على المزيد من الوضوح في مواقف الطرفين. ووجهة نظره الشخصية، والتي أؤيدها، هي أن إجراءات بناء الثقة، وفقا للتعريف، تهدف الى تقوية الثقة بين طرفين في نزاع،وعليه لا يمكن إعتبارها موضوع يتجاوز محتوى عملية المفاوضات التي تجرى بطلب من مجلس الامن، والتي من المفترض إجراءها بنية حسنة وتفضي الى حل سياسي عادل، دائم ومقبول لدى الجميع.
14- سيكون جليا أن عملية المفاوضات التي أعقبت قرار1754 ( 2007 ) لايمكن ملؤها بمحادثات لا تدخل ضمن مقترحات الطرفين، كما أنه من الواضح أن الطرفين لن يبدأ في التفاوض دون توجيه إضافي من المجلس. ويمكن لمجلس الامن أن يوضح أن هذا الحضور في كل جولة من عملية المفاوضات لا يمثل تدخلا في المفاوضات. إن الفقرة 2 من القرار 1754 ( 2007 ) تتضمن عناصر لا يمكن فصلها، وإن حلا سياسيا يضفي العدالة على كل تلك العناصر سيكون لا محالة تعقيدا كبيرا، وسيحتاج الى مفاوضات دؤوبة.
15- إلى ذلك الحد، قام مبعوثي الشخصي بتذكير الطرفين بمبدا: " لم يتم الاتفاق على اي شئ حتى يتم الاتفاق على كل شئ".وهو مقتنع بان قبول هذا المبدا من الطرفين سيكون المفتاح لبداية مفاوضات حقيقية وأن ذلك سيشجعهم على مناقشة المقترحات بما فيها العناصر غير المقبولة لديهم.
16- وكبداية فإن جبهة البوليساريو قد تناقش المقترح المغربي ( 206/2007/S ) حول أسس إستعدادها المعلن لقبول الحكم الذاتي كخيار مادام الاستقلال مطروح هوالاخر كخيار. وهذه الاضافة الاخيرة لا يمكن، طبعا، إعتبارها شرطا مسبقا على الطرفين الموافقة عليها قبل الدخول في مثل هذه المحادثات، إلا أن المغرب لامصلحة له في إفشال المحادثات الامر ببساطة وفقط لعلمه بالموقف النهائي لجبهة البوليساريو. وعلى العكس، فعلى المغرب أن يكون مستعدا لمناقشة مقترح البوليساريو ( 210/2007/S ). قد يبدو هذا أكثر صعوبة بسبب إنعدام التقارب بين المقترحين. إن محادثات حقيقية ستمنح جبهة البوليساريو فرصة لشرح كيفية، حسب تعبيرها " ضمانات ماقبل الاستفتاء "، القيام بالاجراءات حول المواضيع الهامة مثل الموارد الطبيعية والامن، وكذا تفادي عدم الامان والمفاجات التي تنجم طبيعيا عن ظهور دولة جديدة مستقلة.
17- وحتى وإن كان المغرب لا يهتم بشرح جبهة البوليساريو، والذي يفترض مسبقا إنفتاح على صحراء غربية مستقلة، فإنه سيبقى ملزما بالمشاركة في مثل هذه المحادثات إذا أراد التماشي مع القرار 1754 ( 2007 ). وبالنظر الى المعنى العملي للقرار في التعامل مع ذينك المقترحين، فإن مبعوثي الشخصي يميل الى أن كلا المقتحرين موضوع على الطاولة. صحيح أن القرار يميل الى المقترح المغربي أكثر منه الى مقترح جبهة البوليساريو، ولكن المهم في النهاية هو أن مجلس الامن سجل المقترحين في نفس القرار والذي بموجبه دعا الطرفين الى الدخول في المفاوضات. وبالنتيجة فالمقترحين موضوعين على الطاولة ويجب مناقشتهما.
IV – أنشطة ميدانية:
أ/ عسكريا:
18- بحلول 30 سبتمبر 2007 بلغ تعداد المكونة العسكرية للمينورسو 217 فرد، بما فيها الموظفين الاداريين وعمال وحدة التطبيب، وهو ما ينقص عن العدد المسموح به وهو 230 . وفي الفترة قيد التقييم، وفي مجهود لزيادة عدد العسكريين الناطقين بالعربية فقد تم توظيف إثنين من جيبوتي في البعثة بتاريخ 17 أبريل 2007 . ورغم الجهود المتواصلة لزيادة عدد المراقبات العسكريات الاناث في البعثة من واحدة ( من منغوليا)، ومنذ تقريري الماضين تم توظيف مراقبة أخرى ( من كرواتيا ) في بعثة المينورسو خلال فترة التقرير. وأرغب في الترحيب بتوظيف أكثر للمراقبات الاناث في البعثة من خلال مشاركة الدول ببعثاتها العسكرية من أجل أغراض عملياتية وأيضا للتوازن بين الجنسين في مكونات البعثة.
19- إن الوضع العام للمنطقة الخاضعة لمسؤولية الامم المتحدة تعتبر هادئة، وتحت قيادة الجنرال ماجور ( كورت موسقارد – الدانمارك ) وخلفه ( زهاو زينغمين – الصين ) لازالت المكونة العسكرية للمينورسو تراقب وقف إطلاق النار، الساري المفعول منذ 06 سبتمبر 1991 ، وفقا لبند الاتفاق العسكري رقم 01 بين الجيش الملكي المغربي والمينورسو من جهة، والقوات المسلحة للبوليساريو والمينورسو من جهة ثانية. إن هذا الاتفاق العسكري يقسم الصحراء الغربية الى خمس مناطق بما فيها شريط عرضه خمس كيلومترات شرق الحزام، ومنطقتين محدودتين ( 25 كلم شرق و30 كلم غرب الحزام ) ومنطقتين بتقييد محدود تشكلان المتبقي من الصحراء الغربية، وتختلف فيهما القيود على الانشطة العسكرية والدعم البشري.
20- في الفترة من 01 أبريل 2007 حتى 30 سبتمبر 2007 ، قامت المينورسو بـ 4.502 دورية ميدانية و 296 طلعة جوية لزيارة وتفتيش وحدات الجيش الملكي المغربي والقوات المسلحة للبوليساريو ولمراقبة تطبيق الاتفاق العسكري.
21- لاتزال المينورسو تحظى بعلاقات طيبة مع الجيش الملكي المغربي والقوات المسلحة للبوليساريو، إلا أن كل من الجانبين لا يزال يعزف عن مقابلة الاخر مباشرة رغم كل ما هو معروف من إتصالات بين الجانبين والتي تمت عبر لقاءات وإتصالات مكتوبة عبر المينورسو التي تعتبر وسيطا. وكان مقترح المينورسو بتكوين مفرزة عسكرية للتفتيش ( أنظر الفقرة 11 من 249/2006/S ) والذي وضع لتعزيز الثقة بين الطرفين قد حظي بالترحيب من حيث المبدأ من قبل جبهة البوليساريو، إلا أن الجيش الملكي المغربي لم يرد عليه بعد.
22- بقيت خروقات الاتفاق العسكري رقم 01 تقريبا في نفس المستوى من طرف الجانبين مقارنة بالتقرير عن الفترة السابقة. ومن 01 ابريل 2007 حتى 30 سبتمبر 2007 لاحظت البعثة 11 خرقا جديدا من طرف الجيش الملكي المغربي و12 خرقا جديدا من طرف القوات المسلحة لجبهة الوليساريو. تتضمن خروقات الجيش الملكي المغربي دخول طائرة هليكوبتر عسكرية الى المنطقة المحدودة يومي 29 ماي و 21 يونيو 2007 دون أن تلاحظ ذلك بعثة المينورسو، تكوين نقاط مراقبة خارج المراكز في أبريل، ماي ويونيو 2007 ووجود عناصر عسكرية داخل المنطقة المحظورة.وتتضمن خروقات قوات البوليساريو في تجميع القوات في المنطقة المحدودة التقييد ( ميجك ) من 19 الى 21 ماي 2007 خلال الاستعراضات العسكرية المخلدة لذكرى إندلاع الكفاح المسلح ضد إسبانيا في 1973 ، وجودعناصر عسكرية داخل المنطقة الممنوعة، وجود نقطة مراقبة في المنطقة المحظورة في قطاع بئر لحلو الخاضع لسلطة الامم المتحدة منذ يناير 2007 ، وتجاوبا مع نداءات المينورسوالمتكررة تم تفكيك هذه النقطة في 10 يونيو 2007 .
23- في ماي ويونيو 2007 تلقت المينورسو طلبات من الجيش الملكي المغربي للموافقة على بناء مخازن جديدة للذخيرة في المناطق الخاضعة لمسؤوليته لتعويض بعض البنيات التي أصبحت عصية على الترميم.وقد وافقت بعثة المينورسو شرط ضمان إزاحة البنيات القديمة، وستشرف البعثة على عملية الازاحة تلك.
24- تواصل البعثة مراقبة خروقات طويلة الامد يرتكبها الطرفين، وتتضمن وجود تجهيزات الرادارات ودعم دفاعات البنية التحتية من طرف الجيش الملكي المغربي، وإستمرار توظيف العناصر العسكرية من طرف جبهة البوليساريو في المنطقة المعروفة بإسم " الحصن الاسباني – لبيستو- " إلا أن الحصن الاسباني – لبيستو – لم تظهر فيه أية تغييرات من حيث البناء منذ اخر تقرير لي الى مجلس الامن ( الفقرة 18 من 202/2007/S ).
25- خلال الفترة محل التقييم قدم الجيش الملكي المغربي وبشكل ملحوظ عدد الخروقات للاتفاق العسكري رقم 01 المرتكبة من طرف البوليساريو والمسجلة لدى بعثة المينورسو. فمنذ 26 ماي 2007 سجل الجيش الملكي المغربي 32 حالة خرق بوجود عناصر ومركبات داخل المنطقة المحظورة، وأغلب تلك الخروقات دامت فقط لساعات إن لم تكن لايام بعد ملاحظتها، إلا أن المراقبين في بعثة المينورسو ليست لديهم الوسائل للتأكدمن حدوث تلك الخروقات.إلا انه وفي أغلب الحالات يكون المدنيين هم المتسببين في مثل هذه الشكاوى. وبما أن الاتفاق العسكري رقم 01 لا يمنع تواجد المدنيين في المنطقة المحظورة فإن تلك الدعاوى تصبح غير مؤسسة. وفي ثلاث حالات تمكنت المينورسو من تأكيد وجود ثلاث عناصر عسكرية تابعة للبوليساريو في المنطقة المحظورة وسجل ذلك على أنه خرق للاتفاق العسكري رقم01 . وقد كتب المراقب العسكري المكلف من المينورسو الى قائد القطاع في الجيش الملكي المغربي أربع مرات كإجابة على كل خرق خلال يونيو موضحا له أن بنود الاتفاق العسكري لاتخص المدنيينز ومن حينها تناقصت الشكاوى بخصوص تلك الخروقات.
26- خلال الفترة محل التقييم تقدمت البوليساريو بشكوى خرقين ضد الجيش الملكي المغربي، وكلا الخرقين يتعلق بتحليق طائرة عسكرية فوق منطقة اغوينيت في 20-26 ماي 2007 . وبسبب غنعام العلومات الكافية وأجهزة مراقبة جوية لم تتمكن المينورسو من تأكيد أو نفي تلك الخروقات.
27- كما تم توضيحه في تقارير سابقة للمجلس ( الفقرة 26 من 817/2006/S والفقرة 19 من 202/2007/S ) ومنذ بداية مهمة البعثة فغن كلا الطرفين وضع قيودا على حرية التنقل لمراقبي البعثة، وشملت القيود في البداية منع الدخول لتفتيش نقاط القوة لدى الاطراف، ومنع دخول الوحدات لتفقد قوتها واسلحتها وأنظمتها وبرامج الصيانة المقام بها. في 01 يونيو 2006 بدأت المينورسو بتسجيل القيود على تحرك المراقبين كخرق للاتفاق العسكري رقم 01 . ورغم الاتفاق مع جبهة البوليساريو لرفع كل القيود فإن منطقة عسكرية واحدة فقط هي التي ( المنطقة العسكرية الثانية- تفاريتي -) ضمنت حرية حركة تامة للمراقبين العسكريين، بالاضافة الى منطقتين عسكريتين أخريين ( المنطقة العسكرية الثالثة في ميجك والرابعة في أمهيريز ) نفذا الى حد بعيد إلتزامهما بحرية الحركة للمراقبين العسكريين، مع خرقين تم ارتكابهما في ميجك وخرق واحد في أمهيريز إبان فترة التقرير. وعلى البوليساريو ضمان حرية تامة للتنقل للمراقبين العسكريين في المناطق العسكرية الثلاث المتبقية.وبخصوص الجيش المكلي المغربي فقد تمتعت البعثة بحرية تنقل تامة في قطاع اوسرد كما هو مين في تقريري السابق ولكن لا تزال القيود مطبقة في القطاعات المتبقية.
خلال الفترة من 01 أبريل 2007 الى 30 سبتمبر 2007 سجلت 424 حالة خرق إرتكبها الجيش الملكي المغربي و158 حالةخرق إرتكبتها قوات البوليساريو، ويعزى إرتفاع الخروقات لدى الجيش الملكي المغربي الى العدد الكبير لنقاط المراقبة. ويشير الجيش الملكي المغربي الى أن وجود هذه النقاط العسكرية الداعمة بأنه نتيجة لرفع القيود على حرية التنقل التامة للمراقبين العسكريين. ولكن من الضروري أن يقوم الجانبين بتسهيلات أكثر تمكن المينورسو من القيام بمهامها بفعالية.
28- بخصوص الاتفاق 02 و03 فإن كلا الطرفين يواصل تعاونه التام مع المينورسو في تشهير ونزع الالغام والاجسام المتفجرة والذخيرة المنتهية الصلاحية.وخلال فترة التقييم كشف وشهر المينورسو 270 لغم وجسما قابلا للانفجار ومناطق خطيرة. وراقب المينورسو تدمير ما مجموعه 15.494 من تلك الاجسام بما فيها ذخائر تالفة في التخزين.
29- كما هو موضح في تقريري السابق ( الفقرة 21 من 202/2007 /S ) فإن وجود الالغام والاجسام المتفجرة في الصحراء الغربية، بما فيها المناطق التي تعمل فيها اليات ومراقبي بعثة المينورسو، يعتبر أمر مثير للقلق. فمنذ 1991 كانت المينورسو ضحية لثلاث حالات من الالغام وبالقيام بالمهام الليلية يزداد خطر مثل تلك الحوادث. وهذا يثير موضوع حماية القوات الذي على المينورسو القيام به من خلال أنشطة لتدمير الالغام والاجسام المتفجرة وهي مواضيع اساسية لتوفير مستوى أعلى من الامان للافراد العاملين في قوات الامم المتحدة بالصحراء الغربية. ولتوفير الحماية والامان للمراقبين العسكريين الامميين الميدانيين، تخطط المينورسو لتجهيز مركبات بعتاد وقائي بما فيه مدمر الالغام وأحذية واقية.فهذه التجهيزات ستسهل الاستجابة السريعة لاي حادثة ألغام خلال الدوريات، وتضمن مسالك امنة في حقول الالغام لاجلاء المصابين. تبلغ قيمة هذه المعدات 279.400 دولار وسيتم طلبها في الميزانية المقبلة للمينورسو 2008- 2009.
30- إن حماية السكان المحليين محل خطر دائم ايضا، وعدد الضحايا مرشح للارتفاع في حال بدأ اللاجئين في العودة، وفي مجهود للتجاوب مع هذا المجهود، وكما تعرضنا له في تقريرنا السابق، في 15 يناير 2007 بدأ الجيش الملكي المغربي عملية تطهير واسعة للالغام في الصحراء الغربية مركزا على المناطق التي الاكثر خطرا، ونظرا للحراة المرتفعة تم تعليق العملية لثلاثة اشهر في يوليو 2007 وستستأنف في أكتوبر. ومنذ بداية هذه العملية الكبيرة تمكن الجيش الملكي المغربي من إيجاد أكثر من 700 لغم وجسم غير متفجر.
31- ومن جانبها تواصل المينورسو إلحاحها على الحاجة الى تقليص خطر الالغام والاجسام المتفجرة، وعبر خليتها لمكافحة الالغام التي تاسست في يناير 2006 تنخرط المينورسو في تنسيق مع جهات عدة.وبدعم من هيئة الامم المتحدة لمكافحة الالغام نظمت البعثة عدة أنشطة لتقليص وجود الالغام والاجسام غير المتفجرة ولزيادة الوعي بالموضوع لدى الطرفين ولدي كافة الساكنة في الاقليم وفي مخيمات اللجوء بتندوف. كما أن المينورسو على إتصال ببرنامج الامم المتحدة للتنمية في موريتانيا لتبادل الخبرات وتسهيل عمليات مسح الالغام في المنطقة الفاصلة بين الاقليم وموريتانيا، وللبدء في برنامج توعية في المنطقة بخصوص الالغام.
32- ولامتلاك القدرة على التعاون الاكثر فاعلية مع المنظمات غير الحكومية المختصة في نزع الالغام في الاقليم فقد قامت خلية المينورسو المختصة والخلية المكلفة بجمع المعلومات الجغرافية بإجراء تدريبات على نظام إستخدام المعلومات المقدم من طرف المركزالدولي بجنيف.والى حد الان تم تدعيم المينورسو بضابطين عسكريين،والعمل يتطلب الكثيرمن المعرفة والتجربة الميدانية. وإذا تمت ترقية قدرة المينورسو فسيتم طلب خدمة خبير سام في مجال الالغام لزيادة خبرة المراقبين الامميين الذين تتراوح نوبات عملهم فقط من 6 الى 12 شهرا. تبلغ قيمة هذه البرامج 120.000 دولار وسترفع كطلب في ميزانية المينورسو المقبلة 2008-2009 ن هذه البرامج ستمكن المينورسو من إستعادة الذاكرة التقنية للمؤسسة والتي هي مسالة حاسمة في هذا العمل.
33- كما تم التقرير به للمجلس ( الفقرة 25 من 202/2007/S ) قامت منظمة لاند ماين اكشن وهي منظمة غير حكومية في بريطانيان قامت بإجراء مسح وتنظيف لمناطق شرق الحزام في أغسطس 2006 ، بتعاون كبير من هئية الامم المتحدة لمكافحة الالغام والمينورسو. واستمر هذا المجهود وحتى 30 سبتمبر 2007 قامت هذه المنظمة بمسح في 49 منطقة مؤشرة كمناطق خطيرة وشهرت 267 نقطة موضحة الالغام والاجسام غير المتفجرة، وعالجت 114 قطعة من الالغام والاجسام غير المتفجرة. اضف الى ذلك أن هذه المنظمة قامت بمسح في 55 منطقة أشرتها البوليساريو سابقا ولم تجد دليلا على وجود الالغام أو الاجسام غير المتفجرة.
34- يتم تمويل عمل منظمة لاند ماين اكشن من طرف هئية الامم المتحدة لمكافحة الالغام منذ أغسطس 2006، وبدعم طفيف من مؤسسة صندوق أميرة ويلز، وحكومات ألمانيا والنرويج. وسيقدم في ميزانية المينورسو 2008-2009 تسهيل الحصول على التمويل لحماية دوريات المينورسو ودوريات الامداد في المناطق التي ترغب المينورسو إقامة تسهيلات فيها. بالاضافة الى ذلك ستقوم هيئة الامم المتحدة لمكافحة الالغام بدعم جديد لمنظمة لاند ماين اكشن وبدعم من حكومات إيطاليا، النمسا، واليابان ومنظمة البحار المقدسة وهولندا والذي سيمكن هذه المنظمة من العمل على مشروع هام الى منتصف 2008.واعبر عن الشكر الجزيل للمانحين على هذا الدعم. ولتأمين مواصلة العمل في هذا المجال شرق الحزام الى نهاية 2008 يتطلب الامر المزيد من التمويل. واطلب من المانحين المساهمة بسخاء في انشطة منظمة لاند ماين اكشنن ذات الاهمية البالغة في ضمان الامان لساكنة الاقليم المحليين وللمراقبين العسكريين والمدنينن الامميين في الصحراء الغربية.
35- نفذت المينورسو العديدمن الانشطة خلال فترة التقييم للتأكد من حماية الموظفين الامميين وتبيان مقدراتها العسكرية، بما فيها تأشير البقايا، إجراءات إخلاء المصابين ورسم المزيد من الخرائط. وكما تم التقرير به للمجلس قامت المينورسو بتاسيس خلية إستخباراتية في يونيو 2006 بدعم وتدريب تقني من طرف مصلحة الجغرافيات في قسم عمليات حفظ السلام وبعثة الامم المتحدة في ليبيريا، لدراسة موضوع إستخدام الخرائط القديمة. وتتكون هذه الخلية الان من مراقبين عسكريين ومتطوع مختص من الامم المتحدة. خلال فترة التقييم أصدرت الخلية مجموعتها الثانية من الخرائط العملياتية المحدثة لمواقع المينورسو بشكل عام وبشكل أكثر تفصيل لكل موقع على حدة. وتستمر البعثة في تطوير هذه الخرائط بغستخدام صور الاقمار الصناعية ومعلومات من نظام المعلومات العالمي الذي تزود اليات المينورسو باجهزة تعمل به. كما تقوم الخلية بتدريب كل افراد البعثة على العمل الميداني في مجال جمع المعلومات بما فيها النظام الدولي للمعلومات والاعلام الالي. وقد اسهمت الخلية في الرفع من أهلية البعثة في مجال إتخاذ القرار العملياتي عن طريق العمل بخرائط دقيقة ومعلومات ثابتة. والخلية قد قلصت من إحتمال حوادث الالغام لدوريات البعثة وللاليات اللوجستيكية المدنية المتجولة في القطاعات الخاضعة لمسؤولية المينورسو. كما قصرت الامد الذي تحصل بموجبه البعثة على الخرائط والمعلومات الميدانية.
36- لضمان حماية وأمان المراقبين الاميين خلال الانشطة الليلية وخلال عمليات إخلاء المصابين تنوي البعثة تزويد الدوريات الميدانية بهواتف فضائية نقالة مما سيقوي شبكة الاتصالات بالراديو وفعالية الاتصال بشكل عام في حال الطوارئ.
ب/ اسرى الحرب، معتقلين اخرين ومفقودين:
37- يواصل الصليب الاحمر الدولي العمل مع الاطراف المعنية ومع عائلات المفقودين بسبب الصراع.
ج/ مساعدة اللاجئين الصحراويين:
38- تتواصل الانشطة الانسانية للمنتظم الدولي التي تديرها المفوضية السامية لشؤون اللاجئين وبرنامج الغذاء العالمي نيابة عن اللاجئين الصحراويين في ظروف تتسم بالتحدي، ولاتزال سبل الدعم بالمواد الغذائية هشة كما تسبب تأخير النقل البحري في إنقطاع توفير الدعم الغذائي. ولم يتم توزيع مادة النشويات التي تشكل 70 بالمئة من السلة الغذائية الحالية. وفي الاشهر الستة القادمة يتوقع حدوث نقص في النشويات والمواد ذات القيمة الغذائية العالية. ولايزال إنعدام إحتياط غذائي ثابت منذ أكتوبر 2006 مثار قلق عميق.
39- تم إستئناف برنامج التوفير الغذائي في يوليو2007 على إثر توصيات اللجنة المشتركة للتقييم الغذائي لسنة 2007 ، كما تم توزيع حصص إضافية للحوامل والمرضعات وللاطفال الذين يعانون من سوء التغذية الذين تقل أعمارهم عن خمس سنوات لمعالجة مشكل سوء التغذية والانيميا لدى هذه الفئات من المتضررين. بالاضافة الى ذلك تم تخصيص مبلغ 300.000 دولار من قبل المفوضية السامية لللاجئين لتوفير الخضر الطازجة، اللحم والفواكه كإجراء يهدف الى تنويع غذاء اللاجئين خلال شهر رمضان.
40- و في مسعى للوصول إلى هدفها المتمثل في ضمان توفير الماء الصالح للشرب، تعمل المفوضية على سحب خزانات الماء من المخيمات و تعويضها بشبكة أنابيب للماء. و هذا المشروع من المنتظر أن يكتمل بنهاية سنة 2007 في ولاية آوسرد.
41- يستمر قطاع التعليم في الإستفادة من دعم المفوضية حيث تم توفير كمية معتبرة من الكتب المدرسية في الوقت المحدد لهذا العام الدراسي. و مع ذلك فلم تتم بعد تلبية كل إحتياجات هذا القطاع. تم القيام بسلسلة من النشاطات التدريبية حول عدة مواضيع منها الجنسين، التوعية حول فيروس فقدان المناعة المكتسبة و حقوق الإنسان. و بالإضافة إلى ذلك تم الإنتهاء من إعداد مشروع لإيجاد مكتبة شرعية ذات إتصال بالإنترنيت و لكن لم يتم بعد ضمان التمويل الضروري.
42- في مارس 2007 تم تعزيز الوجود الأممي بإنشاء مكتب لمنظمة الصحة العالمية في تيندوف من أجل تقوية الجهود الرامية إلى الوقاية من الأمراض الخطيرة في المخيمات.

د- تدابير بناء الثقة

43- يسرني أن أقرر بأن برنامج تدابير بناء الثقة لا يزال ساري المفعول بنجاح بتنسيق وثيق مع المينورصو و بالتنسيق مع الأطراف المعنية. و تقوم المفوضية حاليا بالنظر مع الأطراف في إمكانية توسيع البرنامج من أجل السماح لعدد أكبر من الإستفادة من هذه النشاطات الإنسانية.
44- منذ بداية البرنامج في نوفمبر 2004 إلى غاية 14 سبتمبر 2007، إستفاد 4423 صحراوي من تبادل الزيارات العائلية، 55 بالمائة منهم نساء و 35 بالمائة أطفال دون سن ال 18. و من بينهم 2116 سافروا من مخيمات اللاجئين قرب تيندوف و 2307 سافروا من المدن في الإقليم. و بهدف توسيع و زيادة عدد المستفيدين و مدة الزيارات تقوم المفوضية الآن بإستكشاف مع الأطراف إمكانية تنظيم الزيارات بإستخدام النقل البري. و من المنتظر أن يكون لتنفيذ هذه العمليات تأثير معتبر على زيادة عدد الأشخاص القادرين على السفر و كذلك إمكانية نقص تكلفة النقل في الزيارات. و بالإضافة إلى ذلك تخطط المفوضية لجولة جديدة من التسجيل للأشخاص الذين يحق لهم التسجيل لهذه الزيارات.
45- خدمة المكالمات الهاتفية المجانية بين مخيمات اللاجئين في تيندوف و الإقليم لا تزال تسير بنجاح. و منذ بداية الخدمة في يناير 2004 و إلى نهاية سبتمبر 2007 تم إجراء أكثر من 83675 مكالمة هاتفية، 85 بالمائة منها من طرف نساء. و كما تم التقرير بذلك آنفا إلى المجلس فإن قيود الميزانية و الصعوبات اللوجستية الناتجة عن بعد الموقع قد حالت دون تأسيس مركز هاتفي في مخيم الداخلة الذي يبعد بحوالي 180 كلم عن تندوف. و يسرني أن أقرر أن المفوضية و بدعم من المينورصو تستكمل إنشاء مركز هاتفي في مخيم الداخلة، و الذي يجب أن يدخل الخدمة في نهاية 2007.
46- في غشت 2007، توصلت المفوضية إلى إتفاق مع الطرفين لتنظيم أول منتدى في إطار برنامج تدابير بناء الثقة و الذي يجب أن ينظم في نوفمبر 2007، في ماديرا، البرتغال. و موضوع المنتدى هو " الثقافة، الإرث و الممارسات التقليدية الحسانية" و إتفق عليه الطرفان بالتنسيق مع المفوضية. و حسب الإتفاق مع الطرفين فإن المفوضية والمينورصو سيختاران 17 صحراويا من مخيمات اللاجئين و 17 صحراويا من الإقليم للمشاركة في المنتدى.
47- و كما هو مبين في تقريري السابق(أنظر S2007/202 الفقرة 35)، يواصل المينورصو لعب دور هام في دعم تنفيذ تدابير بناء الثقة. و تموجب مذكرة تفاهم موقعة بين المفوضبة و المينورصو، تقوم هذه الاخيرة بتوفير الطائرة و الطاقم و النقل البري للبرنامج. تقوم الشرطة الاممية بتسهيل العمل في نقاط الإقلاع و الوصول و مرافقة طاقم المينورصو في زياراتهم إلى المستفيدين. و بالإضافة إلى ذلك يقوم دكتور أو ممرض من الفرقة الطبية الماليزية التابعة للمينورصو بمرافقة كل رحلة جوية. و لا يزال المينورصو يوفر الدعم الضروري اللوجستي ، الأمني و الإداري للمفوضية في تنفيذ البرنامج.
48- إن برنامج تدابير بناء الثقة يعتمد كلية على التمويل من طرف المتبرعين. و رغم المجرى الإيجابي في الأشهر الأخيرة، و إتفاق الطرفين على خطط التوسيع، فبدون المزيد من التمويل فإن مواصلة البرنامج، حتى بمستوى النشاط الحالي، معرضة للخطر. في 15 اكتوبر، و بمساعدة ممثلي الخاص، أطلقت المفوضية نداء لتمويل برنامج تدابير بناء الثقة. و بدون رد فوري من المتبرعين، ستكون المفوضية مضطرة لوقف برنامج تبادل الزيارات العائلية في نهاية اكتوبر 2007. و في رأيي فأنه في هذه المرحلة الحرجة في المفاوضات بين الطرفين ، توفر تدابير بناء الثقة سبيلا حيويا للحوار بالإضافة إلى توفير طريقا حيويا للإتصال بين العائلات المقسمة في الصحراء الغربية. إني أحث بقوة مجتمع المتبرعين لدعم هذا البرنامج الإنساني، لتمكينه من المواصلة و التوسع في سنتي 2007 و 2008. و بالإضافة إلى ذلك فإني أحث الطرفين على التعاون مع المفوضية و تسهيل نشاطاتها بإسم الصحراويين.

ه- المهاجرون الغير شرعيون

بحلول 08 فبراير 2007، بقي في بئر لحلو فقط سبعة مهاجرين، و هم 4 من غانا و واحد من كل من بوركينا فاسو و ساحل العاج و غامبيا. و أثناء الاسبوع الاول من أبريل 2007 عاد أحد المهاجرين المتبقين إلى غامبيا بدعم من اخيه الذي سافر إلى بئر لحلو بتسهيلات من السلطات الغامبية و الموريتانية. و يبقى الآن فقط سبة مهاجرين في بئر لحلو. و بعد طلبهم الاخير للمساعدة للعودة إلى بلدانهم أتصلت المينورصو بالمنظمة العالمية للهجرة. و قد كانت المنظمة العالمية للهجرة، بمساعدة المينورصو، سهلت عودة مهاجرين من الصحراء الغربية كما تمت الإشارة إليه في تقرير سابق (S/2006/817 الفقرة 43 و S/2007/202 الفقرة 37)، كما أجريت خطوات لتنسيق الجهود من أجل تمكين هءلاء المهاجرين من العودة إلى بلدانهم الاصلية بسلام.
50- و خلال فترة التقرير، أخبرت مصادر إعلامية مغربية أن السلطات المغربية واصلت إعتراض سبيل مهاجرين غير شرعيين وجدوا في الإقليم. و في 31 يوليو 2007 أشارت نفس المصادر إلى أن مهاجرين قتلا و أصيب إثنين آخرين بجروح خطيرة أثناء محاولتهم إختراق نظام المراقبة الأمنية في العيون. و إني أدعو كل الاطراف المعنية إلى التعاون في القيام بواجباتهم الإنسانية تجاه المهاجرين، حيثما تم العثور عليهم.

و- حقوق الإنسان

51- على طول شهر ماي 2007، تفيد التقارير إلى أن الطلبة الصحراويين الدارسين في الجامعات المغربي دخلوا في مظاهرات للمطالبة بحق تقرير المصير و الإستقلال للصحراء الغربية. فقد نظت الطلبة الصحراويون الدارسون في جامعة أغادير مظاهرة في 07 ماي 2007 و حسب التقارير فقد إستخدمت السلطات المغربية القوة لتفريق المظاهرة. و أدى هذا الحدث إلى إندلاع مظاهرات و إعتصامات كم طرف الطلبة الصحراويين في جامعات الدار البيضاء و مراكش و الرباط إحتجاجا على رد السلطات في أغادير و مطالبة بحق تقرير المصير.و تشير التقارير إلى رد السلطات المغربية نتج عنه العديد من الإصابات في صفوف الطلبة بعضها خطير، متبوعة بالعديد من الإعتقالات. و قد أكدت مصادر إعلامية مغربية القلاقل الطلابية واصفة إياها بالمشادات العنيفة بين الطلبة و التي أدت إلى تدخل الشرطة لوقف العنف بين عصابات طلابية متصارعة.و قد كتب إلي السيد محمد عبد العزيز، الأمين العام لجبهة البوليساريو، أربع مرات في شهر ماي و مرة في يونيو و مرتين في يوليو و مرة في غشت و مرتين في سبتمبر من سنة 2007 للإحاجاج على الإعتقالات و "إضطهاد" الصحراويين بمن فيهم الطلبة الصحراويين الذين يزاولون دراستهم في الجامعات المغربية و ليلفت إنتباهي إلى إضرابات عن الطعام تفيد التقارير بأن طلبة صحراويين يشنونها أثناء الإعتقال في السجون المغربية.
52- أثناء الفترة السابقة للمحادثات بين الطرفين، أشارت تقارير مصادر الإعلام الدولية إلى إدعاءات مضايقة و إعتقال نشطاء حقوقيين صحراويين من طرف السلطات المغربية في الإقليم. و على مدار طول الفترة حيز مراجعة، أشارت التقارير إلى أن النشطاء الحقوقيين الصحراويين تلقوا أحكاما قاسية بالسجن.
53- و كما تم التقرير حوله سابقا إلى المجلس (أنظر S/2006/249 الفقرة 3) فقد نجمت المشادات بين الالمتظاهرين الصحراويين و الشرطة المغربية في شهر اكتوبر 2005 عن مقتل السيد حمدي لمباركي و هو صحراوي يبلغ من العمر 24 سنة في العيون، 30 اكتوبر 2005. و بعد التحريات التي أجرتها السلطات المغربية حكم على ضابطي شرطة بالسجن لمدة عشر سنوات لصلتهما بهذه الجريمة و ذلك لتهم تتعلق بالتسبب في الجرح بإستخدام السلاح و التسبب غير العمد في الموت أثناء تأدية واجب عمومي.



ز- إدارة البعثة

54- تم إستكمال العمل الأمني في كل المواقع شرق الجدارو في موقع السمارة غرب الجدار. و هذا يجعل مواقع من أصل تسعة تستجيب لأدنى معايير الأمن العملياتي،ببناء الجدران، البوابات و تركيب الأضواء الأمنية. و بالإضافة إلى ذلك ستقام تحصينات وقائية حول الجدران. و يتواصل العمل في المواقع الثلاث المتبقية غرب الجدار. و قد تم بناء أبراج المراقبة و الملاجئ التحت أرضية في موقع واحد (آوسرد)، فيما تتواصل الأعمال في ثلاث مواقع أخرى. و سيتم العمل في المواقع المتبقية في غضون السنة المالية القادمة. و في العيون، تم اخيرا إحراز تقدم في التواصل و التنسيق بين السلطات المحلية و المينورصو في العمل المتطلب لجعل مقر قيادة البعثة و القاعدة اللوجستية تستجيبان لأدنى معايير الأمن العملياتي. و ينتظر أن يستأنف العمل في المستقبل القريب. و يتقدم العمل في تندوف لبناء البوابة و الأضواء الأمنية.
55- بالإضافة إلى العمل على التدابير الامنية، تتواصل كذلك تحسينات المنشآت و البنيات التحتية بخطط لإستبدال المباني السكنية ذات الجدران الخفيفة في المواقع الثابتة إلى بنايات ذات جدران صلبة في خمس مواقع ثابتة. و من أجل ضمان أن يكون الماء الذي يتم جلبه في أغلب الحالات إلى المواقع الثابتة، يستجيب للمعايير الصحية المقبولة، فقد طلبت البعثة محطات تصفية، سيتم تركيبها في خمس مواقع ثابتة و في مقر قيادة البعثة.
56- تبنت البعثة خطة لإعادة تأهيل مهابط الطائرات و بدأ العمل، بجعل واحد صالح للعمل في سهر غشت (أم ادريكة). و يتواصل العمل على مهبطين آخرين (المحبس و آوسرد).و قد إستدعت المينورصو طلبات من متعاقدين أجانب للقيام بهذا العمل، و لكن العروض المستقبلة فاقت تقديرات تكاليفها بشكل كبير التكاليف الداخلية بإستخدام أسعار السوق العادية. و عليه فقد تم إستخدام المواد و التجهيزات المحلية المتعاقد عليها و قام أفراد المينورصو بالعمل، مما مكن من إدخار حوالي 70 بالمائة من أقل الأسعار المحتملة للعقود الخارجية. و إذا تم توفير مصادر التجهيز محليا أو من القاعدة الأممية اللوجستية في برينديسي فإن المهابط الصحراوية الأربع المتبقية ستنتهي بحلول منتصف سنة 2008 ، بإدخارات مماثلة في النفقات. و الخطة معدة لتكييف إحتياجات البعثة بحيث لا يتأثر نقل الطاقم و إيصال المواد الغذائية الطازجة و الدعم CASEVAC/MEDIVAC . و ستتم إحالة الدعم بالمواد الغير قابلة للفساد إلى النقل البري بينما يتواصل العمل في مهابط الطائرات.
57- كجزء من الميزانية 2007-2008، تم تخفيض منصب دولي من منزلة P-4 إلى مستوى P-3 لعكس تغييرات المسؤولية بدقة أكبر. و بالإضافة إلى ذلك فقد تم تحويل منصب دولي إلى صنف الطاقم المحلي. و هذا ينهي تنفيذ توصيات مراجعة التسيير المدني التي أجريت في 2005(أنظر S/2005/648. و S/2006/817). مدخرات النفقات الحاصلة من إعادة الهيكلة هذه سمحت بإنشاء مناصب ضابط الإنضباط و السيرة ضابط الميزانية ضابط التدريب و ضابط نظام المعلومات الجغرافية، في حين يقلل من عدد الطاقم الدولي المسموح به ب 30 في ميزانية 2006-2007.

ح- الوقاية من التحرش و الإستغلال الجنسي

58- في القرار 1754(2007) طالب المجلس بمواصلة إتخاذ الإجراءات الضرورية لضمان أن يحقق المينورصو الإستجابة لسياسة اللاتسامح الأممية بخصوص الإستغلال و التحرش الجنسي. و خلال السبة أشهر الماضية تم التقرير حول حالة واحدة من إدعاء الإستغلال و التحرش الجنسي و تم إتخاذ الإجراءات المناسبة في إطار نظام التعامل مع الموضوع. و لقد بدأ برنامج تدريبي إلزامي و شامل حول معايير السلوك المنتظر من جميع أفراد البعثة و تم تطزير برنامج ترفيهي للتعويض قدر الإمكان عن الظروف المعيشية الصعبة التي تصاحب البيئة الخاصة التي يعمل فيها المينورصو.

V. الإتحاد الإفريقي

يواصل وفد الإتحاد الإفريقي المراقب لدى المينورصو بقيادة ممثله السامي ييلما تاديسي (اثيوبيا) تقديم الدعم و التعاون للبعثة. و لهذا أود أن أؤكد على تقديري لمساهمة الإتحاد الإفريقي.


VI. الجوانب المالية

خصصت الجمعية العامة بقرارها 61/290بتاريخ 29 يونيو 2007 مبلغ 44.3 مليون دولار للجفاظ على المينورصو خلال الفترة من 1 يوليو 2007 إلى 30 يونيو 2008. و عليه، و في حال وافق مجلي الامن على توصيتي الواردة في الفقرة 68 من بخصوص تمديد مأمورية الميتنورصو، فإن تكلفة الحفاظ على البعثة خلال الفترة الإضافية ستنحصر على الموارد الموافق عليها من طرف الجمعية العامة.
61- بحلول 30 يونيو 2007 وصلت المساهمات المقدرة الغير مدفوعة للحساب الخاص بالمينورصو إلى 47.3 مليون دولار. و كنتيجة للمساهمات الغير مدفوعة، لم يكن بإمكان المنظمة تعويض الحكومات المساهمة بالقوات عن تكاليف وحداتها منذ أبريل 2002. إجمالي المساهمات الغير مدفوعة المقدرة لكافة عمليات حفظ السلام حتى 30 يونيو 2007 وصلت إلى 1,417.6 مليون دولار.

VII. ملاحظات و توصيات

62- إني أشارك مبعوثي الشخصي الرأي بأن إنطلاق مسلسل المفاوضات باللقاءين الأولين المنعقدين في يونيو و غشت على التوالي، هو مدعاة للإرتياح. و مع ذلك، فإني أوصي بأن يؤكد مجلس الأمن دعوته الطرفين، المغرب و جبهة البوليساريو، الدخول في مفاوضات حقيقية، و بذلك ضمان تنفيذ أكثر واقعية للقرار 1754(2007).
63- خلافا لتقاريري الأخيرة لمجلس الأمن، أشير إلى و أثناء الفترة قيد التقرير لم تكن هناك زيادة في خروقات الإتفاق العسكري رقم 1، و الذي يعرف نظام وقف إطلاق النار. و بالإضافة إلى ذلك فإني لا أزال منشغلا لكون القيود تواصلت على حرية حركة المراقبين العسكريين الذين يسعون إلى زيارة الوحدات، مقرات القيادة و النقاط القوية لأغراض التحقق. و تقع المسؤولية على الطرفين في ضمان عدم إرتكاب الخروقات من طرف قواتها الامنية/العسكرية و أشجع الأطراف على الإمتثال أكثر لمقتضيات الإتفاقات العسكرية و تقديم العون التام للمينورصو من أجل الإبقاء التام على وقف إطلاق النار و ضمان إحترام المبادئ الأساسية لحفظ السلام.
64- أرحب بالجهود المتواصلة من الطرفين لتنظيف الإقليم من الألغام و الذخائر الغير متفجرة، و تعاونهم في ذلك مع المينورصو. أرحب كذلك بدعم المينورصو المتواصل في مجال التوعية بمخاطر الالغام و نيتها في توفير المساعدة للضحايا كما هو مطلوب. و كما تمت الإشارة إليه في سابقا (S/2007/202 الفقرة 50) هذه النشاطات قد تكون ذات اهمية كبيرة و مضاعفات رخيصة نسبيا في أمن و فعالية البعثة و لها تأثير إيجابي مباشر على سلامة أفراد الامم المتحدة. هذه النشاطات تزيد كذاك من وعي و فهم وجود و دور المينورصو بين السكان المحليين. هذه النشاطات المتواصلة و العملياتية هي جزء من المأمورية الجوهرية للمينورصو و لا يمكن تمويلها كليا عن طريق التبرعات التطوعية. و عليه فإن المينورصو تنوي القيام بتخصيصات تصل إلى 430.000 دولار للنشاطات الخاصة بالألغام في ميزانية 2008-2009 لهذا العمل الحيوي.
65- كما تمت الإشارة إليه سالفا(S/2007/202 الفقرة 49) فإني أود أن أشجع الطرفين على العمل مع المينورصو لبناء تعاون و إتصال مباشر من خلال لجنة تحقق عسكرية مختلطة و تجمعات أخرى لتسهيل عملهم في تطهير الألغام و مواضيع أخرى ذات الإهتمام المشترك.
66. إن البعد الإنساني للصراع بما في ذلك محنة اللاجئين الصحراويين تشكل إنشغالا متواصلا. و في هذا السياق، فإني مرتاح لكون تبادل الزيارات العائلية بين الإقليم و مخيمات اللاجئين في منطقة تندوف بواصلت بدون إنقطاع في فترة التقرير. و يشجعني أن الطرفين إتفقا من حيث المبدأ على توسيع البرنامج و أن منتديات و جولة دجديدة من التسجيلات ستنظم في الأشهر القادمة. إني أحث المجتمع الدولي على إبداء دعمه لتوسيع برنامج تدابير يناء الثقة و أعبر كذاك عن إنشغالي لكون هذه التدابير الإنسانية القيمة لبناء الثقة توجد في خطر و قد يتم تعليقها إذا لم يتم توفير دعم مالي إضافي في المستقبل القريب و إني أحث مجتمع المتبرعين على المساهمة السخية فيه.
67- أود إن أعيد ندائي (S/2006/817 الفقرة 60 و S/2007/202 الفقرة 52) للطرفين للبقاء متشبثين بالحوار المتواصل و البناء مع المفوضية السامية لغوث اللاجئين بغرض ضمان إحترام حقوق الإنسان لشعب الصحراء الغربية. أود إعادة التأكيد على أنه، رغم أن المينورصو لا تتوفر على الصلاحية و لا المصادر لمعالجة هذا الموضوع، فإن الأمم المتحدة تبقى ملتزمة بإحترام معايير حقوق الإنسان الدولية.
68- و في الظروف الموجودة على الواقع، و على ضوء الجهود المتواصلة لمبعوثي الشخصي، فإني أعاقد أن وجود المينورصو يبقى ضروريا للحفاظ على وقف إطلاق النار في الصحراء الغربية. و عليه فإني أوصي بأن يمدد مجلس الأمن مأمورية المينورصو لمدة ستة أشهر أخرى، حتى 30 ابريل 2008.
69- و كخلاصة، أود التعبير عن تقديري لمبعوثي الشخصي، بيتر فان فالسوم لجهوده المتواصلة في البحث عن حل لمسألة الصحراء الغربية. في 10 سبتمبر 2007 سلم الجنرال كورت موسغارد (الدنمارك) مهامه كقائد للقوات إلى الجنرال جينغمين زهاو (الصين). أزد إن أشكر الجنرال موسغارد على تفانيه في العمل أثناء توليه مهمة قيادة القوات كما أتمنى كل التوفيق للجنرال زهاو في مهمته الجديدة. أزد كذلك أن أشكر ممثلي الخاص، جوليان هارستون، و كل الرجال و النساء الذين يخدمون في المينورصو على الطريقة التي تحملوا بها، في ظروف صعبة، المسؤوليات الملقاة على عواتقهم من طرف مجلس الامن.
